The Supreme Court on Wednesday allowed Rep. Mike Bost’s lawsuit challenging his home state of Illinois’ mail-in ballot policy to move forward, issuing an opinion that could have major implications for future elections.
In a 7–2 decision, the high court determined that Bost (R-Ill.) and the others who joined his suit have standing to sue despite lower courts concluding that they hadn’t provided evidence of harm.
“Candidates have a concrete and particularized interest in the rules that govern the counting of votes in their elections, regardless of whether those rules harm their electoral prospects or increase the cost of their campaigns,” Chief Justice John Roberts wrote for the majority.
“Their interest extends to the integrity of the election—and the democratic process by which they earn or lose the support of the people they seek to represent.”
Roberts was joined by conservative Justices Samuel Alito, Clarence Thomas, Neil Gorsuch and Brett Kavanaugh. The sixth conservative Justice, Amy Coney Barrett, filed a concurring opinion backed by liberal Justice Elena Kagan.
Liberal Justices Ketanji Brown Jackson wrote a dissent backed by Justice Sonia Sotomayor.
Bost and his fellow plaintiffs are challenging Illinois law allowing mail-in ballots postmarked before Election Day to be counted up to two weeks after polls close.

Once again, I am reminded why Elena Kagan has some merit (compared to the two other liberals).
If Ketanji writes a dissent, you know the majority was in the right.
But looks promising.
Like in 2020, when plaintiffs “had no standing” until they were “too late to file”.
These two are just hopeless activists. I don't think they pay any attention to laws or the Constitution. They know who "ought" to win, and that forms their decision. Easiest job in the world.
“Once again, I am reminded why Elena Kagan has some merit”
Elena is trying to swing Amy to a feeling, women side of deciding cases. Elena got mad at Kentanji for going way left on an earlier case because it hurt courting Amy.
>> No opinion was released today in the tariffs case. No indication about how soon that might be coming, either.
Here is the Opinion in the Bost v Illinois election case.

Apparently, the tariff decision is not the sure thing the media and leftist “experts” believe it is. If it were, a short ten page decision against the Trump administration would have already been released.
But who can understand it?
Mail-in ballots are exactly how Democrats steal elections in California - with help from voter harvesters, which is legal in the state.
Everyone is sent a mail-in ballot - dead or alive.
Just got a voter information packet in the mail for my husband who has been dead for six years. He’ll get a mail-in ballot too.
They’re still digesting the amicus that Trump filed on Truth Social this week.
> He’ll get a mail-in ballot too.<
It’s time for our side to make a big public deal about harvesting dead Republican ballots and submitting them. It doesn’t have to be followed through on, but flashy billboards, TikTok ads, TV spots and other means should be used to advertise the harvesting. Make the left want to get rid of harvesting.

They know how to fix elections.
Jackson Takes a Swipe at ‘Kavanaugh Stops’ in Dissent Over Candidates’ Ability To Challenge Voting Laws

You can bet that Sotomayor had to do repeated, major editing on what KJB wrote, lest they both look like morons. Even then,...
Talk about the blind leading the blind...
Yep, she’s a lefty but she’s very smart and does have some intellectual integrity. There’s a limit to how stupid she’s willing to look just to get her way. The other two aren’t smart enough to even notice.
What about the 2026 elections?
I’m not sure you can read those tea leaves. I’ve tried year after year to find some rhyme or reason for how and when cases are released only to come up empty.
Wonder if SCOTUS rules will cover all states?.
It should
Democrats checking their nerve pills count.
