Issue: Whether laws that seek to protect women's and girls' sports by limiting participation to women and girls based on sex violate the equal protection clause of the 14th Amendment.

I agree. Unfortunately the role of the Democrat district court judges has been to broaden the readings time after time thus ending up with a SCOTUS hearing. There, we have a couple justices that are way too squishy on the issue (ahem—Gorsuch and Roberts).

If it hadn't been written so badly, and if it had not been passed against the will of the people who "ratified" it, it would not now be causing all the problems it has been causing.

It's own rulings have inevitably brought its precedents into conflict with Title IX and the 1st Amendment's guarantees of religious practice.
If there is ever a leftist majority on the court, they will hold that their fictional expansion of the 14th Amendment overrides Title IX and the 1st Amendment's guarantees of freedom of religion and free speech: the state will be free to force church groups to hire homosexuals and any complaints will be subject to prosecution as "hate speech." Guaranteed.
