Supreme Court temporarily reinstates Texas redistricting map in potential win for Republicans

The United States Supreme Court on Friday night temporarily blocked a lower court order that found Texas’ 2026 congressional redistricting map was likely unconstitutional because it was likely racially gerrymandered.

The order was signed by Justice Samuel Alito, who oversees emergency appeals from the Fifth Circuit Court of Appeals, and will remain in place for at least a few days while the court considers whether to allow the new map to be used in the midterms.

The late night order comes hours after Texas filed its emergency appeal, asking it to take up its redistricting case.

A panel of federal judges ruled Tuesday that Texas Republicans must use its 2021 congressional map, declaring that the state legislature likely racially gerrymandered the one passed this summer.

Just delay until it’s past the no changes date because people already filed to run.

It does say a lot. An emergency order granted on Friday evening before Thanksgiving week indicates they are not dismissing Texas’s position out of hand.

SCOTUS is going to have a hard time dismissing Texas’s new map while allowing California’s to go forward.

This is Texas’s position:

“Texas engaged in partisan redistricting solely to secure more Republican seats in Congress and thereby better represent our state and Texans,” Paxton said in a statement. “For years, Democrats have aggressively gerrymandered their states and only cry foul and hurl baseless ‘racism’ accusations because they are losing.”

So funny... My state, Mississippi... has court ordered racially drawn maps. They are actually sued to create districts based on color. The most racist maps in the country... by court order.

What’s shaping up is that both caliornia and texas redistricting maps are going to be struck down. Why? because the republicans are charging the democrats in california with redrawing the maps on the basis of race. that’s exactly what the democrats are charging the republicans are doing in texas.

the supreme court is now ruling on the constitutionality of jerrymandering congressional districts on the basis of race.

If they rule its ok then both caliornia and texas go through plus every other place in the country that is gerrymandered on the basis of race.

If they rule its not ok then both california and texas get struck down....but a bunch districts all over the south also get struck down because they were jerrymandered on the basis of race.

Bottom line is demsocs will suffer far much more because they gerrymander the districts at a far higher rate, nationwide. So they are going to feel it so much harder right in their political sphincter.

The Dems did worse...They changed district census populations by inserting “immigrants”. I think someone figured it to be about 20 seats.

I believe that John Roberts has made it clear he wants the federal courts out of state districting decisions. The left adapted to this ruling by using racial districting under the Voter Rights Act.

I think the Court is teeing that up to boot it out as well.

“the supreme court is now ruling on the constitutionality of jerrymandering congressional districts on the basis of race.”

In the past racial jerrymandering was the only jerrymandering liberals would allow.

Now the Supreme Court is going to have to rule if racial discrimination is the best way to end racial discrimination.

Well maybe. But in more than 30 years as a member of the bar, I’ve never seen a dissent that peels the paint off the wall like this one does. The first 21 pages are the most important
