Criminals will be stopped from “gaming the system” by choosing trial by jury in order to increase the chances of proceedings collapsing, the courts minister has said, promising to enact radical changes to limit jury trials by the next election.

Drug dealers and career criminals were “laughing in the dock” knowing cases can take years to come to trial, Sarah Sackman said, while warning that inaction would be a road to “chaos and ruin”.

Ministers will legislate to remove the right to trial by jury for thousands of cases in one of the biggest and most controversial overhauls of the justice system in England and Wales in generations – promising the changes will significantly shrink the court backlog by 2029.

The Ministry of Justice is braced for a backlash from barristers and the judiciary as it presses ahead with the measures to tackle a backlog of nearly 80,000 cases, which will create a proposed new judge-only division of the crown court to hear some cases.

We fought the Revolution to secure the rights guaranteed to every Englishman, including the right to be tried by a jury of one’s peers. When we won, we created a government that guarantees those rights in writing.

Apparently, today, an Englishman’s rights can be ended by a vote of Parliament.

Fun fact:

The 6th Amendment to the US Constitution: “In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed...”

Not the second word there, “all”.

Well, the Supreme Court has ruled that “all” actually means crimes carrying a possible penalty of more than six months imprisonment. That flies in the face of common sense. “Six months” is not even mentioned in the 6A.

So you might think you’re guaranteed a jury trial, even in a minor criminal case. Nope.

That’s why the countries freed from the USSR were all urged by the US State Dept to set up parliamentary govts instead of constitutional govts. A parliamentary can do anything, without restraint. Death camps, censorship, slavery... all perfectly legal. Our worst enemy has always been State.

Like I’ve said so many times, a right cannot be taken away, but a privilege can. Thus except for conception, which man has no say in, everything beyond that is a privilege, not a right.
