President Trump on Friday evening responded to a judge’s ruling on SNAP benefits.
More than 40 million Americans rely on SNAP benefits, and the $5 billion emergency fund was not enough to cover the program for November.
Unions and nonprofit groups filed a lawsuit against the US Department of Agriculture earlier this week ahead of the November 1 cutoff.
Funds for the SNAP benefits are drying up because Schumer and the Democrats refuse to vote for the clean CR bill to reopen the government.
US District Judge John McConnell, an Obama appointee, ordered Trump on Friday to use the emergency funds for the SNAP program.
A separate federal judge in Massachusetts ruled the USDA has the power to fund SNAP benefits.
Separately, Judge Indira Talwani, also an Obama appointee, stopped just short of issuing a Temporary Restraining Order and said she will hold a hearing on Monday.
President Trump said two courts issued conflicting opinions on how the SNAP benefits can be funded during the shutdown, so he instructed DOJ lawyers to ask the court to clarify how his administration can legally fund the program.
“Our Government lawyers do not think we have the legal authority to pay SNAP with certain monies we have available, and now two Courts have issued conflicting opinions on what we can and cannot do. I do NOT want Americans to go hungry just because the Radical Democrats refuse to do the right thing and REOPEN THE GOVERNMENT,” President Trump said on Truth Social.
“Therefore, I have instructed our lawyers to ask the Court to clarify how we can legally fund SNAP as soon as possible. It is already delayed enough due to the Democrats keeping the Government closed through the monthly payment date and, even if we get immediate guidance, it will unfortunately be delayed while States get the money out,” Trump said.

“If we are given the appropriate legal direction by the Court, it will BE MY HONOR to provide the funding, just like I did with Military and Law Enforcement Pay. The Democrats should quit this charade where they hurt people for their own political reasons, and immediately REOPEN THE GOVERNMENT. If you use SNAP benefits, call the Senate Democrats, and tell them to reopen the Government, NOW! Here is Cryin’ Chuck Schumer’s Office Number: (202) 224-6542,” Trump added.

This past July, SCOTUS ruled 8-1 that district federal judges have no authority to effect any ruling that reaches outside their geographical district.
If I was SCOTUS I’d be rippin’ pissed. I’d issue a contempt of supreme court to the DOJ for prosecution before midnight.
I appreciate that President Trump gave a crystal clear explanation as to what’s going on, and what he wants to do.
Some will still blame the president and only him, but others may have to consider his remarks right here.
There is nothing vague or ambiguous about his statements.
Even his expression of partisanship is subdued, for him.
Most other presidents would have said nothing at all until Monday or Tuesday; the start of the next business week.

Perfect response by President Trump. It puts the ball squarely back into the judge’s court. Basically Trump is saying to him “Tell me which law you would like me to break in order to comply with your order.”
I’m going to avoid the stores for the next few days, especially Wally World. I’m afraid to see what’s gonna transpire.
The worst issue about all of this, 30-40 percent of all those getting SNAP pmts are migrant invaders...
Basically, SNAP is enabling the looting/theft of the federal bank account that holds the taxpaying citizen’s money...
The gop congress can open the government anytime they want. They already have twice now. They control all three branches.
This isn’t rocket science people.

He is the one in charge of enforcing
their rulings.
Personally, I’d go golfing and ignore them.
States are a different issue, I think it
would a real comedy if the state of New York
tried to arrest Trump.

Did you notice in President Trump’s statement he said “Americans” so I think that means no benefits for illegals.
Civics lesson in Budgeting for the Judges
Congress receives the President’s budget request and begins its own process.
The House and Senate pass a budget resolution to set overall spending limits.
Appropriations subcommittees “mark up” and create individual appropriations bills that detail spending for specific agencies and programs.
(Here’s the rub!)
Both the House and Senate vote on the appropriations bills, and once passed, they are sent to the President to be signed into law.
3. Execution
The budget becomes law, and the executive branch, led by the President, implements it.

Federal agencies use the allocated funds to carry out their programs and operations.
The democrat judges, playing the little boy in DH Lawrence’s The Rocking horse Winner: “There MUST be more money!”

These judges just took one important page out of the Democrats' playbook.
1. The GOP was never going to let the SNAP benefits expire if left to their own devices. These judges saved them the trouble and the challenge of a political balancing act to bring the House back into session to vote on a SNAP-only appropriation.
2. A scenario that runs well into November where the government remains shut down but nobody is complaining about people starving to death doesn't help the Democrats at all. In fact, this plays into the GOP hands by effectively enabling them to re-open the government by one department or program at a time -- even if it takes until June of 2026. And they can cancel stupid/costly programs just by refusing to re-authorize them.
SNAP isn’t designed to assist these recipients anyway. It’s designed to subsidize Walmart and giant corporate grocery chains.
