Colorado’s law banning “conversion therapy” for children confounded the Supreme Court on Tuesday, with justices saying it seemed to shut down speech...
Kaley Chiles, a licensed counselor, has challenged the law, saying it prevents her from bringing her Christian perspective to her work with families as their kids grapple with gender dysphoria or same-sex attraction.
“Ms. Chiles is being silenced, and the kids and families that want her help are unable to access it,” said James Campbell, her lawyer.
He said if Colorado prevails, counselors and therapists could turn into “mouthpieces of the government” and be muzzled on other issues such as abortion and divorce.
But Shannon Stevenson, Colorado’s solicitor general, said the state banned gender conversion therapy because studies have shown it’s unproven and unsafe.
She said banning it is similar to the state prohibiting any other medical treatment that violates the standard of care doctors are expected to deliver.
“Counseling is a medical-based practice,” Ms. Stevenson told the court, emphasizing that states can regulate it and that banning conversion therapy is a “reasonable regulation of professional conduct.”
“That treatment doesn’t work and poses a risk of harm,” she said.
Ms. Stevenson said the state’s law would allow a “life coach” or a member of the clergy to offer the same perspectives as Ms. Chiles.
The solicitor general said the difference is that the state licenses counselors, which carries an imprimatur of the state and a fiduciary responsibility to a client to deliver the best care.
“This is just a fundamentally different relationship,” she said. “No one has ever suggested that a doctor has a First Amendment right to say the wrong advice to their patient.”
That wasn’t convincing to Justice Elena Kagan, an Obama appointee, who said doctors prescribing medication or advising on surgery is different than a counselor’s work on sexual orientation or identity issues.

I’m sure KBJ is confused as to how she put her robe on.
Wow, Elena Kagan said that? If she’s on the right side of this issue (that the ban is unconstitutional), then it’s going down.
My advice to the headline writer would be the same FReepers give each other all the time: Try reading the article before replying or, in this case, writing the headline. The headline is incoherent and does not accurately characterize the article. “Wary of” would be accurate; “confused by” is not
My thought as well. It'll probably end 8-1, with the one being the non-biologist who can't tell her butt from a whore on the ground.
Kagan might be wrong on many things, but she is usually very strong on free speech issues.
The Colorado law violates the US and Colorado constitutions by imposing a restriction on a counselors speech.
uh....NO! It is NOT!
Most homosexuals were molested as children. That is CHILD RAPE! This law bans RAPE therapy!
Oh really?? How about, then, banning the practice of affirming gender transformations in children to begin with? Doubtless, there exists MUCH more evidence of the mental health issues this brings... never mind the ACTUAL harm involved."
“... with justices saying it seemed to shut down speech...”
Seemed to? Seemed to? It 100% does so.
open and shut case that should be 9-0 for freedom of speech
“But Shannon Stevenson, Colorado’s solicitor general, said the state banned gender conversion therapy because studies have shown it’s unproven and unsafe.”
You can be certain those conducting the studies had skin in the game and fudged the stats to reach the “correct” conclusion.
Gender-derangement indoctrination therapy good, gender-derangement conversion therapy bad.
Colorado’s solicitor general, said the state banned gender conversion therapy because studies have shown it’s unproven and unsafe.
Oh wait, I bet he means that trying to talk people out of such insanity is the problem.
Kagans brain sometimes works.
The Left believes someone can be man/boy trapped in a woman/girl body and support irreversible, mutilating “treatment” and surgeries to “change” them, but don’t believe someone who has desires / struggles they don’t want in their life to have treatment to potentially change that.
They are a walking contradiction that makes zero sense...on every issue.
Kagan normally has been on the side of religious liberty. Not always, but normally. She and Breyer both.
Define "wrong advice."
George Orwell called it "doublethink."
I’m sure KBJ is confused as to how she
is able to put food in her mouth and eat
Since she LIES like Son of Satan
Barack Hussein Obama and
about not being able to
define what a “WOMAN” is
