The Department of War will ask President Donald Trump for final approval to execute the Fort Cavazoz shooter, Nidal Hasan, a DOW official told the Daily Caller News Foundation exclusively.
The execution, if approved by Trump, would be the first carried out by the military since 1961. Hasan, a former Army Major and psychiatrist turned radical Islamic terrorist, killed 13 people and wounded 32 others during his notorious rampage on the Army base in 2009.
“I am 100 percent committed to ensuring the death penalty is carried out for Nidal Hasan,” Hegseth exclusively told the DCNF. “This savage terrorist deserves the harshest lawful punishment for his 2009 mass shooting at Fort (Cavazos). The victims and survivors deserve justice without delays.”
Hasan is currently imprisoned in the U.S. Disciplinary Barracks at Fort Leavenworth, Kansas. Hasan lost his final appeal to his 2013 death sentence in April 2025, according to the San Antonio Express.
Under the Army’s regulations, the Army staff will put forward the recommendation for Hasan’s execution. The packet will then be passed to the Army secretary, then the Secretary of War to give “additional recommendation to the President,” the DOW official told DCNF.
“Inmate Hasan’s packet is now in the staffing process for presidential action,” the DOW official said.
Service members are governed by the Uniform Code of Military Justice, and thus are subject to different procedures should they receive the death sentence. Hasan is one of four people on military death row, according to the Death Penalty Information Center.
Hasan told a military mental health panel that the shooting was justified because the victims were “going against the Islamic Empire,” according to the New York Times in 2014. However, the Army controversially decided not to pursue terrorism charges at the time, the Pentagon instead designating the shooting as “workplace violence.”
The Trump administration has consistently shown its willingness to exercise capital punishment as a valid form of justice for particularly heinous crimes.
The White House did not immediately respond to the Daily Caller News Foundation’s request for comment.

Hasan would be the first since a rapist was executed in 1961. He would be transported from Fort Leavenworth, the place where military prisoners are held, to Federal Correctional Institute Terre Haute, a 445-mile trip via Interstate 70, in order to begin the proceedings, as Federal Death Row is in Indiana.

This is a miscarriage of justice, to think this scum bag committed his atrocity in 2009 and is still breathing. He should have been put to death years ago. Kudos to Hegseth to take this guy out.

But I would have never thought that Hassan will see an execution.
Heck, in the Obama era I think they labeled this as home grown or self radicalized, minimizing what it was.
I also never would have thought that they will call it the department of war.
Or resume executions.
All good things.
I think it needs to be done extremely cautiously and only for the most extreme cases where there is 0% chance of making a mistake, but this is such a case.
There are simply put, people that need to die. Their presence on this earth prevents closure for their victims.
I prefer hanging, but will settle for firing squad.
Maybe he can get an Obama judge to let him off because there wasn’t even a fort Cavazos in existence when the shooting occured.
But why take him to Indiana. Take him back down to Killen and tie him to a post for target practice. I’d say hanging would be more appropriate, but more difficult since he couldn’t stand on the gallows.
Or better yet, contract out the execution to the Norks. They have some creative ways of carrying out executions.

My understanding is that the President's prior approval is not required, which makes Sec. Hegseth's request pro forma.
