WARNER ROBINS, Ga. — A federal appeals court rejected on Tuesday a transgender Houston County deputy's lawsuit over the county's health insurance policy, claiming the policy's provision denying coverage for sex change surgeries amounted to sex discrimination.
The 11th Circuit Court of Appeals ruled that the provision did not discriminate on the basis of sex but instead denied specific medical treatment.
The case centers on Anna Lange, who joined the Houston County Sheriff's Office in 2006 and transitioned from male to female in 2017.
But the problem began when Lange asked the insurance company administering the Houston County health plan to cover her gender reassignment surgery. Her doctors listed it as "medically necessary" care and the insurance company originally agreed to cover it.
But the insurance company later reversed course and denied coverage, finding it was not allowed under the terms of the county's health insurance plan.
Lange sued and originally won on summary judgement in 2022 in the U.S. District Court for the Middle District of Georgia.
Then, after Houston County appealed to the 11th Circuit Court of Appeals for the first time, a split panel of three judges ruled in May 2024 that Houston County discriminated against Lange.

They are pretty solid. We are blessed here in the 11th Circuit to have upstanding law-abiding judges who believe in the Constitution.
I’ve had the pleasure to meet most of those currently on the bench and they are solid! I even received a set of drink (scotch?) glasses with the court’s logo on it as a gift from the judges years ago.
