The 10 Years Since Obergefell Have Proven Its Critics Right
The Federalist ^ | 6/20/25 | Nathanael Blake

Posted on 06/20/2025 5:15:45 AM PDT by CFW

The alarmists were right. Ten years after the Obergefell decision enacting same-sex marriage nationwide, its opponents — smeared then and now as cranks and bigots — have been vindicated. Same-sex marriage was sold to the public through a campaign of lies, and the lies are hurting people.

It is therefore no wonder that support for same-sex marriage seems to have peaked, and may even be starting to decline, especially on the right. Of course, GOP leaders, whether from MAGA or the old establishment, have no stomach for the fight. They just want the issue to go away. They and the left thought that opponents of same-sex marriage should surrender or slink off into the social shadows and fringes.

But instead, the remaining opponents of same-sex marriage seem emboldened. The latest example comes from the Southern Baptist Convention, which overwhelmingly voted for a resolution calling for Obergefell to be overturned. It is not surprising that Southern Baptists are still against same-sex marriage, but engaging the issue shows that they do not consider it a lost cause. And they may well be right.

During debates over same-sex marriage, Americans were endlessly told that there was no slippery slope. We were assured that this was about loving adults, and that the gay-rights movement was not going to infringe on anyone else’s rights, let alone try to groom kids in any way. They lied.

Pretty amazing how much ruin and destruction the devil has been able to accomplish via homosexuality. Guess it worked so well that trans became the next wolf in sheeps clothing...

Heterosexual sin and drug use paved the way.

Better yet get the government out of the marriage business. Anything that ties people to the government, like taxes and property issues, should be done through business partnerships or civil unions, stop calling it marriage. Handle divorces the same way. Remove all tax policies, deductions, and credits that deal with “marriage”. You file your taxes based on your income, which brings to light the need for a flat tax or ad valorem tax instead of the current thieving method.

Marriage is a religious institution. If two people want to live together, so be it, if you want to be married (as only men and women can) that is between you and God. Quit letting them hijack words and corrupt non-government institutions.

Get government out of marriage.

Clarence Thomas said at the time that there is plenty to challenge in Obergefell. It was mixed and baked in thoughtless haste.

So in fact it was about undermining real marriage all along?

Yet another right wing crackpot talking point proven right after all!

Thanks (not) to Anthony Kennedy, who was a lawyer in San Francisco and Sacramento earlier in his life and influenced his thinking regarding this matter.

Totally agree. The government sanctions marriage to be able to codify property rights and questions regarding children in the case of divorce, and to pass out goodies like tax deductions and dependent benefits.

“Same sex marriage” was a scam to enable the goodies to be passed out to homosexual couples. Most of the costs are directly borne buy the businesses who have to provide spousal benefits to the couple.

Allowing these people to adopt children has been utterly destructive and normalizing homosexual relationships continues to gnaw at the fabric of society.

I’m still extremely angry at the GOP for breaking their solemn promise to push for a marriage amendment only if the courts got out of hand on the issue.

That happened over 20 years ago.

Clarence Thomas said at the time that there is plenty to challenge in Obergefell.

One aspect brought to the fore throughout the debate and after is that the Supreme Court never actually defined what marriage IS. The decision is of the shakiest material.

Saying that marriage is just what anyone wants it to be effectively destroys marriage. If anything is marriage, then nothing is marriage.

Yeah, the GOP stepped to the side as that slope became slipperier and slipperier. The cowards just didn’t want to risk it.

God does not ordain or bless same sex marriage. The reason a government does is purely financial. Taxes because you are “married” come into play. A marriage blessed by God holds far more weight mentally, physically, and spiritually than a marriage certified by a government clerk that can not be blessed by God.

What irritates the &$#@(^!! out of me is these types are allowed to adopt children. That is absolutely horrible and mentally, spiritually, and physically abusive to the children affected by their adoptions.

Kennedy was born and raised in a Catholic family in Sacramento, California. He was appointed by President Reagan.

That's a faulty argument, and I hear it far too much. The government is NOT "in the marriage business." If it were, it would be a non-viable business, because the business expenses far outstrip the proceeds.

All the government does is record marriages. That's it. And what it records, it must recognize. And what it recognizes, it must define.

Kennedy was poised to vote against it citing his reluctance to upend centuries of human civilization. He had a lesbian niece who put the screws to him so he flipped. So we have all this madness that has followed because Kennedy was afraid he would not be invited to Christmas dinner.

Since the decision, the Congress passed and Biden signed the Respect for Marriage Act which codifies in federal law that it is the states that determine what marriage is, which always was the case legally (not religiously), despite activists’ lies. However, states must recognize marriages performed in other states for federal purposes. This would enable states to challenge the decision based on their one man, one woman definitions of marriage so that they no longer have to issue licenses to same-sex couples. Will a state pursue this?

I get both arguments. A decade ago I leaned towards FReeper Resolute Conservative's position: get the govt out of the marriage business. I was afraid of the slippery slope of the govt getting more into our personal relationships of heterosexuals if we tell the govt that they can decide if gays can or can't call themselves married. All while my fellow Christians warned about a different slippery slope leading to pedo and bestiality and polygamy (FReeper fwdude's position).

A decade later and it's obvious that I was wrong, my fellow Christians were right, as was Rush with his repeated statement that the left always "defines deviancy down".

Nice post. I agree 100%. Marriage is a religious practice not a civil practice. Love is modern construct. I asked my grandmother if she loved grandpa when they married. She laughed and said no. She had a child, he had farm but no wife, he had a need, she had a need so it worked. She did say one day she realized she loved him but that was after a few kids and some hard times. I was in the middle of my marriage heading down and she told me women are like milk once they go bad ain’t nothing you can do with them but toss them out. I said but I love her, grandma laughed again and said no you don’t your pride is just hurt. Go find another women you will get over her quick. Grandma did drink a bit, but she was wise😀

Long winded way of saying love is not like instant noodles, takes more than five minutes. So these fools that say but they love each other, are full of it. I am conservative with a libertarian streak. Two men want to legally be a couple, not my business. It is my business when you tell me my religion is wrong and my values are wrong.
