Trump to revoke California vehicle emission rules on Thursday

President Donald Trump plans to sign a trio of resolutions Thursday to revoke California’s nation-leading vehicle emissions standards.

Sen. Shelley Moore Capito (R-W.Va.), author of a resolution to nix the state’s electric vehicle sales mandate via the Congressional Review Act, and Rep. Kevin Kiley (R-Calif.) confirmed that the White House has scheduled the signings at 11 a.m. on Thursday.

Trump’s signature will finalize his administration’s monthslong effort to thwart California’s authority to set stricter electrification rules for passenger vehicles and commercial trucks, along with higher standards for heavy-duty diesel engines.

Trump’s EPA revoked an earlier version of California’s vehicle emissions rules through an 18-month regulatory process during his first term, but Republicans’ vote last month to expedite the rollback through Congress marked the first time waiver approvals have been considered subject to the CRA since President Bill Clinton signed the law in 1996.

California Attorney General Rob Bonta has promised to fight the decision, saying last month that he plans to sue once Trump signs the resolutions.

Spokespeople for Bonta did not immediately respond to requests for comment. Daniel Villaseñor, a spokesperson for California Gov. Gavin Newsom, said the state is ready to defend its rules.

“If it’s a day ending in Y, it’s another day of Trump’s war on California. We’re fighting back,” Villaseñor said in a statement.

So California wants to SUE to skew the car and truck market so badly that everybody in the US will be forced to buy EVs? Does anybody here think Cali’s EV mandate is just about Cali?

NY has has the same law banning Gas Cars sales gradually until 2035 when they will ban all sales of Gas cars.

They are banning the sale of Gas Appliances even before that.

I would think that president Trump would want to stop that crap in NY as well.

I believe that NYs law states that it will follow CAs standards, but doesn’t set its own standards.

I agree - the way it works is that if enough of the country is under EV rules, then it becomes VERY EASY for the feds to apply those rules to the rest of the country. That’s why it needs to be stopped NOW, rather than just laughed at by people in Red States.

It’s actually easier under such a regime for the companies themselves to simply switch to manufacturing EVs for the entire American market. Fed involvement not necessary.

the EPA under President Clinton granted California a waiver from preemption for its greenhouse gas emission standards for motor vehicles, starting with the 2009 model year. This waiver allowed California to set its own, stricter standards due to its severe air pollution problems. Assertion of Authority: During this time, officials within the Clinton administration stated that the Clean Air Act gave them the authority to regulate carbon dioxide and other greenhouse gas emissions, though they indicated no immediate intent to do so under the act.

California's Special Status:

It's important to understand that California has a special status under the Clean Air Act. Congress initially granted California an exemption from the preemption provision because the state had already adopted new motor vehicle emissions standards before March 30, 1966, and could demonstrate a need for more stringent standards than those established by the EPA. This exemption allows California to request waivers from the EPA to enforce its own emissions standards, provided those standards are at least as protective of public health and welfare as the federal standards and are needed to address compelling and extraordinary conditions.

In summary, while the Clinton administration was involved in facilitating the implementation of cleaner car standards and granting California a waiver for its greenhouse gas emissions regulations, California's ability to seek such exemptions stems from a unique provision within the Clean Air Act itself, rooted in its historical efforts to address air pollution.

Clinton admin claimed the Clean Air Act governed carbon emissions which it was never intended to. They then claimed that these "greenhouse gas" carbon emissions fell under the Clean Air Act's exemption for California for pollution (remember when LA had really bad smog problems in the 60s and 70s?). But of course, C02 is not pollution so California should have no exemption. The Trump administration is free to simply reinterpret this in the same way the Clinton administration reinterpreted it.
