Will James Comey Go to Jail for '8647' Post? Legal Analysts Weigh In

The prospect of former FBI Director James Comey being prosecuted for a social media post that some have alleged was a threat against President Donald Trump is quite low, multiple legal experts tell Newsweek.

Why It Matters

Comey on Thursday posted an Instagram photo of shells on a beach that were aligned to read "8647," which Trump and other conservatives have surmised is an assassination threat against the president.

What To Know

Comey issued a follow-up post after the fact, saying that he saw the shells and "assumed" they were "a political message. I didn't realize some folks associate those numbers with violence."

Trump and others in his orbit did not take the post the same way.

"If you're the FBI director and you don't know what that meant? That meant assassination. And it says it loud and clear," Trump said during a Fox News interview on Friday. "Now, he wasn't very competent, but he was competent enough to know what that meant."

FBI Director Kash Patel said on X that his agency was "in communication with the Secret Service and Director [Sean] Curran. Primary jurisdiction is with SS on these matters and we, the FBI, will provide all necessary support."

The linked connection of "8647" to Trump is that he's the 47th president of the United States, and the term "86" generally signifies eliminating something or someone. It's a term used in different connotations, including in the restaurant industry or the broader general meaning of banning or kicking someone out of a venue like a bar, club, casino, etc.

"I have been one of Comey's long-standing critics," George Washington University Law School professor Jonathan Turley told Newsweek. "However, I do not believe that this would be a viable criminal case.

Comey should not be convicted for attempted murder, he should be convicted of sedition and treason (and then hung).

They’ll milk the shame and embarrassment but they can’t lock him up. It plays into the hands of those who call Trump a fascist even though they use those tactics themselves.

Yup. I figure there is zero chance of a conviction here. But, still, he should certainly be put in solitary for 2 years while he awaits a trial. And he and his family should definitely be bankrupted. Take him off the board and send a message. Then, in 2027 or 2028 we can find him Innocent.

Arrested on what charge, assault? That requires threat of immediate harm.

Inciting threat to another? Again doesn’t that requires threat of immediate harm?

Careful we don’t give the Left ammunition for more gov’t overreach.

Possibly a civil suit would be in order and sanctions if he’s being paid by the gov’t.

But good that this is in the public.

It shows what sort of guy Comey really is.

He was never neutral / fair / objective.

He was a straight up political hack. He’s one of those that thinks bringing his ideology and political bias into the office and decision making is justified, since it’s far more righteous than what others believe. Albeit, he knew to keep up the appearance of being fair and objective while in office.

Any reasonable prosecutor would find the facts very problematic for (Democrat Hack), but would decline to file an indictment given the situation and parties involved.

Now if you're Mike Flynn being interviewed by the FBI, and you were asked "What you had for lunch?", and responded with "corned Beef Sandwich", when you had Roast Beef, you would be in prison for false statements to the FBI.
