As usual the writer studiously avoids any comment or even notice of the clause “subject to the jurisdiction thereof.”
Did they move it?.......
I think we lose this one 😞
Quite possible but that doesn’t mean the end of it.
Congress can change the immigration law.
AFAIK, no other country in the world allows birthright citizenship like we do.................
wong’s parents were legal residents under a chinese treaty
This ignores the Indian Citizenship Act of 1924, which declared American Indians born within the US to be US citizens.
American Indians born in the US were "subject to the jurisdiction" of another nation, so the the 14th Amendment did not apply.
They will uphold this unconstitutional BS
John Roberts is going to go, and probably Barrett as well.
So it will be 6-3 at best and birthright will be affirmed with no changes and birth tourism will continue. Maybe 7-2.
It needs to be said that Wong Kim Ark never addressed illegal aliens.
No he can't. But that is not what he is doing.
The author is just a leftist hack.
“would potentially be stateless”
Absolute nonsense that the Mexican Reconquistadors have been peddling for 45 years.
Any child of a foreign citizen would be recognized as having that nationality. In the case of Mexico, they have a comprehensive and relentless program to do just that: give citizenship to their “citizens abroad” as they call them.
Total misdirection and propaganda.
Can a non-citizen be compelled to serve as a member of a jury? Can a non-citizen be involuntary conscripted into US military service? If not, then they are not "subject to the jurisdiction thereof".
Yeah, that stood out to me as well.
WHAT THE HELL???
I have undivided sovereign allegiance "to the Flag of the United States of America and to the Republic for which it stands".
The U.S. government is NOT my country, it's a bunch of jokers who allegedly are in charge of governing. They are not "the Republic". The Republic is defined by the Constitution.
The author (Jean Lantz Reisz Clinical Associate Professor of Law, Co-Director, USC Immigration Clinic, University of Southern California) is off her meds.

Two thieves break into your house, steal your belongings, and give them to their children. Those children claim the right to keep them despite their parents never having the right to them. Their claim to the fruits of a crime is null and void.
I think you’re right, with Roberts the turncoat driving the bus off the bridge.
Love to be wrong about that.
They essentially gave the Federal government special powers to provide for cosmic justice against discrimination.
Those same powers are now being used by enemies of America, like Mozlems, to bend the law their way.
For something Thomas Jefferson thought would be used frequently it has not been used once. Ever amendment added has come from Congress and to no ones surprise has added to Federal power. Its about time the States had that Convention and claw back power from Fedzilla.
Like Barret and Roberts would ever vote to end it. The only way to do this is if the cowardly GOPe make it a law.
