Lankford: Illegal Immigrants Should Get Due Process

Senator James Lankford (R-OK) said Tuesday on CNN’s “The Arena” that someone being deported for illegally being in the United States should get due process “before they’re removed from the country.”

Host Kasie Hunt said, “President Trump sat down for an extensive interview with Kristen Welker at ‘Meet the Press’ over the weekend. She asked him whether he would uphold the Constitution in providing due process to people who are deported and his answer was not yes. Are you confident that President Trump will uphold the Constitution?”

Lankford said, “I am. I think his answer was, I’ve got good attorneys advising me on all those things, and they’re going to make sure they get it right. What’s been confusing on this is some people see due process like us as American citizens, and that’s a right to a jury trial, that’s all those different things. That’s not true for due process for someone who’s not a citizen of the United States. It’s a different process. It’s often just literally what people call an immigration judge, which is not a typical federal judge or a state judge; this is someone that’s in the bureaucracy.”

The only due process illegals should get is an opportunity to prove that they’re here legally. Nothing more. And that’s not for their benefit or because they’re entitled to it, but simply to safeguard against the rare and unlikely event of a citizen or legal resident being falsely identified as being here illegally.

Due process is not as fixed as the North star. It depends on the case. If somebody just hopped the border, their feet still muddy from the Rio Grande, a Border Patrol Agent ought to be able to just shove him back in the river, so long as he makes sure he doesn’t drown or come back. And that’s “due process” in that case. The only process that a wet back whose back is still wet is due.

This is not the first time that Lankford wanted to pass to pass a "bipartisan immigration bill." The first time, Biden was in the WH. Obviously, I did not want to make it easier for Biden to destroy the US faster. But Dems are relentless. They will continue seeking a way to elect another Dem POTUS. I am afraid that the next one could finish what Biden started.

Note that it would take 60 senate votes to pass such a bill. Why would Dem and RINO senators vote for a "bipartisan immigration bill" unless they thought it promised them more power?

To be fair, he says what is accurate and true. The headline is again misleading.

“Due process” for an illegal, (as he points out), means you go before an immigration judge. You don’t get a jury trial. You don’t have the same rights as US Citizens.
