The ruling is a blow to Trump’s deportation efforts and permanently bars removals under the Alien Enemies Act in South Texas.
A Trump-appointed federal judge ruled Thursday that the president exceeded his authority by invoking the Alien Enemies Act to summarily deport Venezuelan migrants, dealing a blow to the administration’s deportation efforts and permanently barring such removals in South Texas.
In a 36-page ruling, U.S. District Judge Fernando Rodriguez Jr. in Brownsville, Texas, rejected Trump’s declarations that the United States was being invaded by a Venezuelan gang to justify using the act to deport migrants without a hearing. He said the president’s action “exceeds the scope of the statute.”
Officials deployed the act in March to summarily remove more than 130 immigrants to El Salvador, many of whom had been detained in South Texas. But Rodriguez said the proclamation lacked evidence of an invasion and sidestepped existing immigration law, the Immigration and Nationality Act, which spells out the proper procedures for removals, typically including a hearing. Lawyers for the plaintiffs say this is the first decision permanently invalidating the administration’s legal justifications for using the act.
Rodriguez wrote that the “the historical record renders clear” that Trump’s invocation of the act is “contrary to the plain, ordinary meaning of the statute’s terms.” As a result, he wrote, the administration cannot use it, based on the reasoning in Trump’s proclamation, to remove immigrants from the country.
“The President cannot summarily declare that a foreign nation or government has threatened or perpetrated an invasion or predatory incursion of the United States, followed by the identification of the alien enemies subject to detention or removal,” Rodriguez wrote.
Lawyers for immigrants who filed lawsuits to block the swift removals celebrated the decision. Other courts have ruled that the government cannot use the act to deport...

What I see with all these judical rulings against a sitting president is treason, it is an attempt to over throw our dually elected government and should be treated as treason.

I think that the point is to slow Trump down so that as little as possible happens on his watch.
Dems can hope that things will go better for them after future elections.
Democrats are slowing Trump down on a lot of fronts however, they are not going to win more at the ballot box unless they devise more/better ways to steal the vote. I don’t think that’s going to happen.
So that means that 1.) dems slow trump down 2.) they lose again at the same rate or worse in the next two elections because their messengers and messages are poor.
If they lose by wider margins in the next elections—the supreme court is going to side with trump more often. the more often the republican win at the ballot box—the more difficult it becomes for the supreme court to rule against them.

I heard this exact same argument from liberal friends of mine about the border wall. Trump didn’t build the wall like he promised! Um... he build a LOT of it, as much as he could in the time allowed after fighting liberals in court over it most of his 1st term!
