A federal judge in West Texas halted the deportation of suspected Tren de Aragua gang members under the Alien Enemies Act.
US District Judge David Briones, a Clinton appointee, on Friday ordered the release of two suspected TdA members. The judge admonished DOJ lawyers and said they “have not demonstrated they have any lawful basis” to keep the couple detained.
The couple, Julio Cesar Sanchez Puentes and Luddis Norelia Sanchez Garcia, arrived in the US from Mexico in 2022 and were granted temporary protected status (TPS) by the Biden Regime. President Trump terminated the TPS program, and the couple was arrested earlier this month at the El Paso airport.
“There is no doubt the Executive Branch’s unprecedented peacetime use of wartime power has caused chaos and uncertainty for individual petitions as well as the judicial branch in how to manage and evaluate the Executive’s claims of Tren de Aragua membership, and the invocation of the Alien Enemies Act as a whole,” Judge Briones wrote, according to The Associated Press

Good question. I think we know the answer.
As I understand it, there are other legal avenues through which these gang bangers can be deported. This decision only deals with using the Alien Enemies Act as the vehicle for deportation. That doesn’t mean I agree with the judges decision. Trump’s policy position is that the gang members should be treated as enemy invaders and I agree with him. But it should be kept in mind that there are other options for deportation available.
The AEA allows them to be deported with the status of foreign enemy, allowing them to be transferred to a third party country, like El Salvador, for imprisonment as essentially, prisoners of war.
Short of that, Tren de Aragua members could still be deported as civilians to Venezuela, assuming they’d take them or to any third party country willing to take them. They could also be tried for crimes they may have committed while here and sentenced to imprisonment in the U.S.
What makes all the fuss about “The Maryland father” so ridiculous is that he could easily be deported right back to El Salvador through normal legal deportation avenues, were he somehow to be brought back here. And upon resending him back to El Salvador, Bukele could easily throw him right back into prison for crimes he’s committed in El Salvador, and there’d no legal objections our judges could raise about it. It would be an internal matter for El Salvador to deal with at that point.
