A New York official has enforced the state’s “shield law” to protect an abortionist who sent abortion pills to individuals in Texas and Louisiana, which resulted in complications for those women.
Acting Ulster County Clerk Taylor Bruck said in a statement that he will not file a summary judgment against Dr. Margaret Carpenter, who is accused of sending abortion drugs to a woman in Texas. The judgment sought a civil penalty exceeding $100,000 due to Carpenter’s failure to appear in court on February 12 in response to Texas’ lawsuit alleging she prescribed mifepristone and misoprostol (the abortion pill regimen) to a woman in Texas in violation of that state’s law. She was ordered to pay the $100,000 fine for committing the abortion and $13,000 in attorneys’ fees and court costs plus interest.
Carpenter is one of the founders of the online abortion pill distributor, Hey Jane.
“In accordance with the New York State Shield Law, I have refused this filing and will refuse any similar filings that may come to our office,” wrote Bruck. “Since this decision is likely to result in further litigation, I must refrain from discussing specific details about the situation.”
Texas Attorney General Ken Paxton said, “I am outraged that New York would refuse to allow Texas to pursue enforcement of a civil judgment against a radical abortionist illegally peddling dangerous drugs across state lines. New York is shredding the Constitution to hide lawbreakers from justice, and it must end.”
The Texas woman who took the abortion drugs suffered serious complications and required emergency care. Carpenter was also indicted in Louisiana for mailing the abortion pill to a teen in that state; that teen, too, was injured and required emergency treatment. Last month, New York Gov. Kathy Hochul invoked the state’s shield law in rejecting Louisiana Gov. Jeff Landry’s request to extradite Carpenter. Hochul said of the county clerk’s decision, “New York is grateful for [Bruck’s] courage and common sense.”
New York Attorney General Letitia James also praised Bruck for “doing what is right.” She noted that “we will not allow anyone to undermine health care providers’ ability to deliver necessary care to their patients.”

I’m sure I’m missing the “nuances”, but I am imaging a situation where I might, say, murder someone in my home state of MA and then drive to NH to escape the police. I am located, and MA asks the state of NH to extradite me home to MA to stand trial, but NH says “We have a shield law” and refuses to extradite me to MA to face murder charges.
That can’t happen, right? We have laws that say states cannot operate that way, right?
Dr Margaret did not have a license to practice medicine in TX. Therefore she cannot prescribe treatment.
The same would then also apply to New York.
Anyone in Texas (or any other state) can send machine guns, firearm suppressors, normal capacity gun magazines, knives, gas stoves, alcohol, and cigarettes to New York residents, including minors, because New York government officials claim state laws don't apply to other states.
If I mailed a weapon to someone in another state, with full knowledge beforehand that they were going to murder someone with it, I would be an accomplice to murder. I'd be arrested and extradited within the hour. Margaret Carpenter became an accessory to murder in Texas once she sent murder pills that are illegal in Texas, to a resident in Texas.
I guess that would also mean that Texans could ship 17-50 round magazines, ammunition, tear gas, and untaxed cigarettes to New York.

Can Texas sue in federal court? I can’t see how these shield laws are constitutional.

I would imagine this civil penalty in Texas could escalate to a criminal penalty. Then the NYShield law would be useless. Or a resourceful west Texas federal judge could place a TRO on the NYShield law and demand compliance.

I don’t know the particulars, but states do have extradition laws. They have to agree to extradite, so a state could conceivably refuse to do so. I think it would normally involve that state wanting to prosecute the criminal for any crimes committed there first.
That’s ok. Let New York try to enforce any civil or criminal rulings in Texas. And just another reason for companies to relocate to the Texas Stock Exchange.

This woman is under criminal indictment in Louisiana too and NY is refusing to extradite her. I can’t see this ending well for NY but the democrats will be able to say they tried.
Anyone who calls abortion "health care" should be immediately hit in the mouth for telling a disgusting and offensive evil lie.
