Who will stop the judges?

We've been watching federal judges playing President or Commander in Chief. I guess that these judges, coincidentally appointed by President Obama or President Biden, have concluded that Article 2 powers apply to a presidency only if a judge in some blue island agrees with his decision.

Glenn Reynolds asserts that this is not going to end well for the judiciary. Let's check out what he wrote:

Now Trump is drawing out the nation’s partisan district judges, causing them to overextend themselves in ways that will cost them -- and the judiciary itself -- a lot.

Lower-level federal judges have been issuing orders against the administration, aiming to block Trump-ordered spending cuts, halt layoffs of government employees and more.

In the latest incident, Chief Judge James Boasberg of the US District Court for the District of Columbia on Saturday tried to block Trump’s deportation of more than 250 illegal aliens tied to the Venezuelan Tren de Aragua gang, a federally designated foreign terrorist organization.

Trump was relying on the Alien Enemies Act of 1798, a venerable statute that allows the president to order the deportation of “alien enemies” in times of war, invasion, incursion or threat thereof. 

Trump’s deportation order declared that Tren de Aragua members were specifically exported here by the hostile Venezuelan government, as he placed them on airplanes and sent them to points south.

Though the law dates back to the 18th century, it has been employed regularly in modern times. A 1948 Supreme Court case, Ludecke v. Watkins, interpreted presidential authority under the law very broadly, holding that it precluded judicial review of the removals.

Trump should write an Executive Order that only the SCOTUS can issue a TRO against the President, lower/inferior courts must petition SCOTUS for action.

Congress should then make this law. Make SCOTUS do their job.

Best solution, new law:

Henceforth, all government workers’ (anyone whose pay comes from taxpayers) pay and benefits will be based on and mirror successful outcomes of jobs completed.

Example: Three-quarters of all Ninth Circuit Court rulings are overturned by the Supreme Court. Going forward, the pay and benefits of the Ninth Circuit Court are now slashed by 75%. Do this for all the courts and watch how quickly court decisions line up with the Constitution.

THE SPECIFIC JUDGES ARE LOST IN EXTRA-CONSTITUTIONAL SPACE.

BAN THEM FROM USING ALL U.S. GOVERNMENT BUILDINGS, PROPERTIES, FORMS OF COMMUNICATIONS, AND TRANSPORTATION SYSTEMS.

PLACE THE SPECIFIC JUDGES AT THE TOP OF THE NO-FLY LIST.

PUT A TARIFF ON EVERY WORD UTTERED BY THEM.

The left is judge shopping. Shouldn’t we be doing the same? Bearing in mind, only one district judge opinion can hold as valid at a time. Couldn’t you “set up” a test case with someone actually on your side and get it with the “right judge” to preempt everything else?

Someone willing to stand up and say “F@#$ off!”. Then, remove them — pi$$ of Roberts’ opinion. Impeachment should be the first step when a judge violates/ignores the Const.

Dems will use Trump’s balking to impeach him, EXCEPT... if they get rid of him, they’ll have to deal with Vance, and I don’t think they want THAT.

Maybe, but force them to review each case. Currently they get to pick and choose their workload, overload them.

Trump’s people are saying that the Constitution makes no mention of “District Court Judges”. This is a constitutional crises and Trumps legal team should camp out on the steps of the SCOTUS to insure a hearing. Who’s in charge bunch of rogue hack judges or the POTUS?
