Businesses sue Hochul over ‘illegal and misguided’ $75B climate law, claiming it will cause a spike in costs to consumers

A coalition of business and trade groups is suing the Hochul administration over a law that will force oil, natural gas and coal companies to pay $75 billion for spewing carbon emissions.

Gov. Kathy Hochul’s administration claimed the law was necessary to combat the companies contributing to climate change for decades — but critics said the extra costs will be passed along to consumers through prices at the pump and heating bills.

“This law is not only illegal and misguided, but it will likely increase the cost of energy, placing an unnecessary burden on New Yorkers and consumers nationwide — especially during a time of already high prices,”

The lawsuit filed in Manhattan federal court claims Hochul and the state legislature exceeded their authority by approving the New York Climate Change Superfund Act last year, and asked that it be tossed out as unconstitutional.

The law aims to essentially charge fossil fuel companies for their purported shares of “global, lawful greenhouse gas emissions based on completely unsubstantiated ‘attribution science,'” the plaintiffs claim.

Federal law prohibits New York from imposing liability on fossil fuel energy producers for harms allegedly caused in the Empire State by greenhouse gases emitted outside the state,

there’s no way that an estimated 38 energy firms could pay back those costs without raising prices to customers

Gov. Kathy Hochul and the Democratic-led legislature have also banned gas stoves, furnaces and propane heating in new buildings. In December, Hochul extended the state’s fracking ban by prohibiting a new technique to use carbon dioxide to extract natural gas.

The gripes come amid outrage over Con Edison’s request to jack up electric bills by 11.4% and send gas bills soaring 13.3% for its 3.6 million customers.

Democrats live in a phantasy land.

Everyone else lives in the real world where you either make a profit or you go out of business.

Only national governments can continue to lose money year after year and continue to do business.

Businesses don't pay taxes, they collect taxes. Hochul knows this, but also knows that her loyal constituents are all fired up to stick it to energy companies.

Why? I don't know because I live in the real world.

Because Schumer is the big fish; the insider's insider. Gillibrand - capable of coherent thought if she wanted - is merely a placeholder... a "chair moistener from sector 7G" who basically exists to give Schumer two seats in the senate instead of just his own.

If New York wants such a tax, great. But legally, all companies being hit with this should be required to pass through the costs solely to NY and not a penny gathered from outside NY.

“A coalition of business and trade groups...” (& energy) should cut ALL ties w/ GOVT in the State. Let the Governor+ keep their (taxpayer funded) luxury “job(s)” going via their GREEN DREAM.

‘Oddly’, govt ISN’T @ the forefront by using ONLY solar/wind, as they wish the rest of the pleebs to do.

Not sure what state it is in, but they have a bill banning ALL gaso,ine powered devices by 2035 or so. I imagine her royalty hochul will do likewise soon. They don’t have to prove it actually causes anything, all they have to do is claim that it does apparently.

California is the leader of this nonsense and there are several other states that are following California's lead. New York happens to be one of them..
