A violent Tren de Aragua gang member who is suspected of murder has been released from prison in Chicago despite a 2022 deportation order.
Pedro Colmenares, 33, of Venezuela, entered the United States in 2022 and was ordered to be deported by an immigration judge just a few months later.
In 2024, two years after he was ordered to be deported, Colmenares was back in the hands of law enforcement on a weapons charge.
“DHS issued an ICE detainer on Colmenares, but because of its sanctuary policy, Cook County refused to comply with the detainer, and Colmenares was set free,” ..
This week, Colmenares was apprehended again over suspected involvement in the murder of a 25-year-old man in September. The Chicago Police Department held him for three days before he was released.

Chicago police said probable cause existed to place the illegal migrant into custody for murder earlier this week, but ultimately the Cook County State’s Attorney’s office declined to press homicide charges, explaining they “carefully reviewed” the case and found insufficient evidence and “uncooperative witnesses.”
Colmenares is facing charges in a shocking kidnapping and sexual assault of his former girlfriend last October in Chicago. He is charged with domestic battery with bodily harm for allegedly pulling up in a car to the 27-year-old Hispanic woman and telling her to get in “or I’ll shoot you.”
Police say he then drove the woman against her will to a separate location on Chicago’s west side, where he allegedly “battered and sexually assaulted the victim” over several days.
Colmenares was ordered to appear before a judge in March but was not placed under electronic monitoring.

Perhaps Pam Bondi can use this as a test case for state and local officials violating federal law. Challenge the entire sanctuary city concept at the Supreme Court.

Secretary of DHS is supposed to take custody of the person whether or not the local system cooperates.
But failure of the local system to cooperate should mean that they are sent to Gitmo for harboring terrorists, as Tren de Aragua has been declared to be a terrorist organization.

That’s pretty much true, but I’m willing to give her some space on this issue.
It seems the folks doing the releasing may be technically correct, IF the ICE folks don’t have valid hold orders, a judge signed and all that.
It still needs to be tested, certainly. But in the interim, my hope is that the DOJ under Bondi is rapidly working to iron out the process to make it less ‘mushy’.
We certainly do not need any more Gowdy’s in the mix.
This “In your face” defiance of Team Trump cannot be of any long-term social or political benefit. In fact, it is difficult to come up with even a very temporary short-term respite, as most assuredly, this miscreant is certain to work a whole LOT of misery and mischief, before he is brought in and dealt with properly.
This gets trickier now that that gang has been given the terrorist designation. Seems like a national security issue is brewing. I wonder if one judge would order another judge released from cuba.
Until the DOJ initiates criminal charges against those obstructing the federal government then they will just keep doing what they are doing. It is time to see state officials raided at 5 in the morning and put in handcuffs.
I’ve never been able to understand why the concept of a sanctuary jurisdiction has never been challenged in court. The Trump administration needs to sue the various sanctuary states and cities and let the Supreme Court finally rule on the matter. Or alternatively, Congress needs to pass a law making sanctuary jurisdictions illegal. That would give the FBI and DOJ the legal grounds for arresting state and local leaders of the various sanctuary states and cities. Undoubtedly the left would end up challenging it’s constitutionality but it would eventually reach the Supreme Court.
