A federal judge on Tuesday declined to block Elon Musk's Department of Government Efficiency from accessing government data or firing federal employees.
U.S. District Judge Tanya Chutkan ruled that plaintiffs – who represented more than a dozen Democratic-led states – failed to show the necessary evidence of harm caused by DOGE's access in order to be granted a temporary restraining order.
The decision from Chutkan, an Obama appointee, is a blow to the coalition of 14 attorneys general who sued last week to temporarily restrict DOGE's access to federal data personnel information about government employees.

I think that the liberal judges know that if Trump can’t fire them, he can eliminate their position. And the judges ultimately know that an impeachment, even though the Senate probably will not vote to remove them, means that they will never advance beyond their current position.
So as a result, they decided to follow the Constitution, no matter how much it pains them.
Roberts moving on the other case may have helped her see the light.
She knows who is currently buttering her toast.

Julie Kelly just described how shrewd the judge is and how she’s setting up to try to do far more damage with a long-term injunction, based on the claim that Musk should have gone through Senate approval.

Musk is an advisor who has no decision-making authority. The DOGE teams report to each department head and all decisions are made by the department heads.
Furthermore, each DOGE team has a lawyer and HR representative on it, so the legal side and the terminations side are also covered by appropriate oversight.
Chutkan would be inserting herself into the inner workings of the Executive branch, which separation of powers forbids going all the way back to the Marshall Court.
