DHS Reinstates Migrant Protection Protocols, Allowing Officials to Return Applicants to Neighboring Countries

WASHINGTON – The Department of Homeland Security (DHS) made the following announcement regarding restarting the Migrant Protection Protocols (MPP) immediately.

On January 25, 2019, Department of Homeland Security (DHS) Secretary Kirstjen Nielsen issued Policy Guidance for Implementation of the Migrant Protection Protocols (the MPP Policy). The MPP Policy is an exercise of the authority granted to DHS pursuant to Section 235(b)(2)(c) of the Immigration and Nationality Act (INA). That authority permits the Secretary of DHS to return certain applicants for admission to the adjoining country from which they are arriving pending the completion of removal proceedings pursuant to Section 240 of the INA.

Between Jan. 20, 2021, and Oct. 29, 2021, Acting Secretary David Pekoske, and later Secretary Alejandro Mayorkas, repeatedly attempted to suspend or terminate the MPP Policy. Following a series of legal actions, Secretary Mayorkas’s final attempt to terminate the MPP Policy was stayed by a federal court. See Order Granting Stay, Texas v. Biden, 2:21-cv-67 (N.D. Tex. Dec. 15, 2022). The Department of Justice, seven months after that stay was entered, voluntarily dismissed the federal government’s appeal, acquiescing to keeping the MPP Policy in effect for the foreseeable future. See Texas v. Biden, No. 23-10143 (5th Cir. Jul. 17, 2023).

According to representations made by the federal government in court, DHS at all times complied with that court order, but the facts on the ground “render[ed] restarting MPP impossible.” Defendants’ Supplemental Response Brief at 10, Texas v. Biden, 2:21-cv-67 (N.D. Tex. Oct. 6, 2023). The situation at the border has changed and the facts on the ground are favorable to resuming implementation of the 2019 MPP Policy.

More of the lawless Biden regime. The administration fought the 'stay in Mexico' protocol to a standstill in court, and then said the 'facts on the ground' prevented them from restarting the program. They couldn't win in court so they just shut it down via stay and 'couldn't restart it.'

The stay actually stopped their attempts to kill MPP. What they did was say, “Okay, we want to comply with your stay order and resume MPP, but we can’t because ‘facts on the ground’ preclude it.”

“Stay in Mexico” conforms to the international law.
Refugees (the real ones) are people who run from serious life threatening persecutions in their home country.
According to International law, they are required to take refuge in the FIRST country where is SAFE for them to stay.
After they take the refuge, they may apply for immigration status in other countries.
So practically only citizens of Mexico and Canada (and some stowaways jumping from ships/planes) are eligible to claim refugee status in the USA!!!.
US would be obliged by international law to give refuge only to persecuted Canadians or Mexicans. Both of these courtiers are considered free, so nobody is eligible!
Citizens of other countries must stay in first safe country, so at minimum in Mexico or Canada!
If Mexico and Canada implement the same policy, they can order refuges to stay e.g. in Guatemala, etc.
Mexico is actually trying to do just that, with mixed results.

It looks like Guatemala actually agreed (for some money, I am sure) to take in all those people who have nowhere to go.
That may be the solution - send everybody who claims they have nowhere to go, to Guatemala.
Since it is very poor country, the few real refugees will stay there, and the rest will return home.

Easy test, who is the real one!

Not really. The “facts on the ground” - which they don’t enumerate and weren’t even pressed on- were that Biden was in office and that as such they would never ever consider conditions in Mexico or Canada ‘safe’ enough to resume the program.

Mexico does have their immigration forces and from what I have heard and seen, they are a lot rougher than the US ones.

And, lately, they even have a lot of unwelcome immigrants who want to settle in there! (Unemployment in Mexico is very low right now.)
I have heard the even Mexican citizens have been harassed and deported when they could not prove their citizenship! (Chiapas )

But, during Biden reign, they knew, that these people were just passing through, so why bother?!
I would do the same!

The only thing they need is to get some push, some excuse and motivation and they will work harder!

Trump’s task is actually pretty easy, just motivate Mexican authorities to do their job and half of the problem is solved!
