Turns out the H-1B ‘lotto system’ is totally and completely rigged…

The H-1B “war” of 2024 is destined to go down in social media history. It’s equal parts productive and chaotic, with pro-foreign worker advocates like Elon Musk and Vivek Ramaswamy squaring off against America First MAGA forces. Ultimately, this debate is a healthy exercise for the America First movement, airing its internal conflicts—especially before Trump’s anticipated return to the White House.

Honestly, we’re dealing with a system so broken it’s beyond repair—especially the so-called “lotto” system at the heart of the entire H-1B scheme. Calling it “rigged” would actually be a compliment.

Yes, it’s really that bad.

Eric Fan:

Every year, a lottery determines who gets an H-1B visa to work in the US. The game, it turns out, is rigged.

Outsourcing and staffing firms are exploiting loopholes, crowding out US employers and immigrants who play it fair.

We have exclusive data to show it for the 1st time That said, we shouldn’t throw the baby out with the bathwater. Vivek and Elon don’t need to be thrown to the wolves over this issue. Sure, they could use a crash course in America First principles, but they also deserve the opportunity to get creative and course-correct. A good starting point? Taking a hard look at the system they support and acknowledging just how disastrous it really is.

Congress created H-1B in 1990 to help American businesses get the world’s top talent. Instead, outsourcing and staffing firms flooded the system.

They bring in lower-level workers and pay lower wages. They game the lottery to gain unfair advantages.

Say you’re a regular American business that wants to hire a foreign graduate from a top US university. You would lose the candidate to lottery most (70%) of the time. That’s what happened to Sandeep Maganti, a talented...

Through rain and wind and weather
Hell-bent for leather
Wishing my girl was by my side
All the things I’m missin’, good vittles, love and kissin’
Are waitin’ at the end of my ride

I love the freedom of information the internet provides!

We all know that if the Government is giving away some advantages or money, the system will automatically become corrupted.

And here it is - within 48 hours of the start of the debate, here is someone, with crystal-clear FACTS, logic and history - showing us exactly how corrupt it is.

H-1B system should be scrapped and rebuilt for what it was originally sold to us about.

Yes I think the original idea was itself a sham. But if you want some avenue for talent you can’t honestly find here than its clear it should be reformed completely.

Require employers to offer jobs to Americans at the prevailing wage that Americans in that field, not H-1B visa holders, receive. If none are available, then allow a provisional H-1B visa with the stipulation that the employer must sponsor and train an American for that position who would replace the H-1B visa holder at the end of his training.

Two possible tweaks to deal with the cheating

1) Have a significant (> $1,000) application fee to discourage multiple applications per candidate

2) have the candidate be able to switch employers once here.

If the applicant is really that much of a Rockstar the employer should be willing to pay well over the prevailing wage for such talent. My guess is that only perhaps 2,000 such extortionary people a year would be admitted under these guidelines.

I know of way too many graduates in these fields who cannot even get an interview.
The excuse is that they have no experience.
They are replaced by H1B’s who fake their experience, and start at lower salary.

If our Ed system is flawed these companies should be investing in apprenticeship programs to ensure OUR graduates may hit the ground running.

But I know for certain that the universities are NOT interested in that even when it would cost them NOTHING!

They get plenty of money from the Chinese students.

Don't need any others.

Allowing Chinese students into our universities to learn/steal our tech is amazingly stupid.
We are at the same times China’s best trade partners and at an undeclared war with them!
They continually probe our infrastructure, there are current threads here on FR about Chinese Gov. hacking of our Gov. and corporate systems.
Too much of their tech is STOLEN, we are so stupid we are paying to build the weapons systems they are using to force their influence into area’s they have no legitimate rights to.
If the USA engaged in a tiny fraction of the “Expansionism” the Chinese do daily we would be vilified for our “Imperialism”.
Double standards or none is still the MSM rule.
