Could Biden do it? Is it a felony or misdemeanor when someone enters the country illegally?

Well they would still be here illegally the day after he leaves office. He can’t geant them legal status for future crimes.

That’s basically the Executive Branch passing a law by fiat declaring that all immigration is legal. Who needs a legislative branch? The Emperor has spoken.

I doubt that he can pardon non-citizens. Further, I'm not sure how can do anything substantive at this point given the questions about his cognition.

Ok so they won’t criminals anymore

Just non citizens who aren’t suppose to be here

Why can’t they still be deported?

This would provide more impetus to declaring that either A) the 2020 election was fraudulent and Biden wasn’t president or B) Biden was senile and not really president at all.

Wipe the past 4 years away. Don’t let any of his crap have standing.

***********,

Many would argue it should be a capital offense.

Pardons are only for specific people. A President has no power to pardon some abstract group of people. For example, he couldn’t pardon all left-handed people or something.

Not how our law sees it. Look up the “Defacto Officer Doctrine.”

Crossing the border illegally is a crime - a federal
misdemeanor the first time, and a federal felony for
anyone who has previously been convicted. The US
President can pardon that crime. But the illegal alien
remains an illegal alien, legally subject to civil
deportation.Nov 11, 2024

But they would already have a pardon for any immigration violations, so the government would have basis to arrest, try, or deport them.

100% Correct. Every day they are here after they are pardoned, they are committing a new crime.

Just by being here they are committing new crimes.

The president can pardon federal crimes. Citizens or not, it doesn’t matter.

If Biden does it, the DOJ should a full scale investigation of the Biden crime family and jail them all

I looked up the definitions of reprieves and pardons.

Those are both for either after charges have been filed or there’s a conviction. In that case the person would have to be named.

Otherwise blanket pardons could be given to say, anyone who donated to ActBlue for all past and future crimes, creating a class of people above the law.
