Daniel Penny trial trending toward possibility of hung jury

The jury in the high-profile trial of Daniel Penny continues to weigh the ex-Marineโ€™s justification for placing Jordan Neely in a chokehold for several minutes on a New York City subway, but may wind up deadlocked.

The jury has sent five different notes to the judge requesting key pieces of evidence since it began deliberations on Tuesday. The central issue facing the seven women and five men is whether Penny was justified in placing Neely in the chokehold after witnesses said Neely was threatening passengers on the train

How can it possibly be a hung jury??? This should have been Not Guilty in a matter of minutes.

OF COURSE.

But even in NYC, folks aren’t happy with getting assaulted and killed every day.

It’s gotten out of control.

If one was going to go to court for this thing...with Mayor Adams supporting him...now is a lot better than a year or two ago.

Sounds like idiots on the jury. Alvin needs to do better if this gets redone on jury selection. These days you gotta think hard and fast about intervening.

At least one juor must have common sense. Contrat this trial to the Derrick Chauvin trial for George Floyd’s death. Some potential juors asked to be dismissed because they feared BLM would terrorize them and their families if there was hung jury or vote to acquit

There’s obviously a non-mover or a group of them, so probably will be a hung jury.

Big difference though. Finding a NYC jury to convict Trump of something/anything might be a lot easier than finding a NYC jury that has never been hassled by the crazies on the subway.

My guess? Hung jury.

Several decades ago I was a member on a criminal case jury. The perp was known to the victims, several witnesses, lots of physical evidence, yet one jury member claimed that she wasn't certain and could not vote to convict (multiple votes, on and on.)

The judge decided to not retry, the perp walked.

This case could be an inverse to the above, with most members voting to acquit and one or a few wanting conviction for reasons having nothing to do with law or evidence.

We'll see.

I thought “certain” wasn’t the threshold, but instead it was “beyond a reasonable doubt”...or is this just semantics of what is basically the same thing?

My guess? There's no book deal in a five-minute jury deliberation.

The jury is taking its time to review the evidence so they can "tell-all" later about how judicious they were in this "highly emotional" and book-hyping "controversial" trial.

Same thing, in this case.

We voted secret ballot at first, then it was clear who the one hold out was. IIRC, she said a whole range of bogus rationalities, I think "beyond a reasonable doubt" was one of them.

(But it was so long ago, that I'm not... ahem... certain.

Because it’s Manhattan and 7 female jurors. I hope the ones (probably male) hold out for not guilty till the others give up in order to go home.

A hung jury is just as good as a not guilty one. I’d be fine with that. Lotta idiots on the OJ jury too-too many.

Penny will have a gofundme page if he doesn’t already. Trump should offer him a job when its over. He should then call for all the good men to step up in those situations.
