Jordan Neely’s father is suing Daniel Penny over his son’s chokehold death on a New York City subway car as the jury still deliberates whether or not to convict Penny of manslaughter.
The suit, filed in New York Supreme Court on Wednesday, accuses the Long Island Marine veteran of negligent contact, assault and battery that caused injuries and Neely’s death last year.
Neely’s father, Andre Zachary, “demands judgment awarding damages in a sum which exceeds the jurisdictional limits of all lower Courts which would otherwise have jurisdiction,” according to the lawsuit. It was filed Wednesday as jurors in Penny’s four-week-long Manhattan trial broke for a second time without reaching a verdict.

Sorry, but self defense is not “negligent contact” nor “assault and battery”. Sorry for your loss sir, but your son played stupid games and paid the consequences for threatening to kill people on the subway- it is perhaps you that should be sued for what your son caused to happen!
Like Floyd Neely was a waste of human skin.
There’s no insurance. Penny doesn’t look very affluent. Why would a lawyer take a case like this on a contingency basis?
One of the people Neeley harassed and threatened should sue Neeley’s family/estate for trauma as a result of his actions.

Th3y should,have reached an immediate and unanimous verdict of not guilty, or hung jury with the majority voting innocent with only 1 or 2 who thought otherwise given that I’m sure there are at least a few blind liberals on the jury.
Penny should turn around and sue the father for failing his child. All the passengers should sue the father as well.
Why don’t they base it on Neely’s earning potential?
Andre Neely better have a lot of evidence proving he tried to help his son long before that day on the subway.
I heard the whole family neglected Jordan and even mocked his mental illness. He was a homeless vagrant. Where was Dad all this time?
I often wonder that about homeless people. Almost all these homeless have families somewhere, families who clearly have not taken care of them. Some of these homeless are mentally ill and have burned bridges with family who tried to help them. I’m sure many caring family and friends have tried to help these people before they end up in the streets.
Was he involved in his son’s life? Or was he just a sperm donor?
This is activist driven. I would like to know who’s behind the persecution of this man.
