Daniel Penny's subway chokehold trial resumes Monday, with attorneys expected to begin their closing arguments after a break for Thanksgiving.
The 26-year-old architecture student and Marine Corps veteran faces up to 15 years in prison if convicted of manslaughter for the death of Jordan Neely, a 30-year-old mentally ill homeless man who was high on synthetic marijuana when he barged onto a subway car and started screaming threats at the passengers.
Neely had a warrant out for his arrest at the time, the case's final witness revealed before the defense rested its case – as well as a lengthy criminal history and schizophrenia.

Penny was just trying to protect passengers on the subway, but this is a NYC jury, and they are probably lib radical indoctrinated residents.
Goetz was acquitted of the shootings, but was convicted for having a gun, if I recall. The Civil findings came later.
Yep I’m afraid this young man has some incarceration time in his future.....I fear the jury will discount all the psychiatric testimony and only see a White man caused a black man to die, regardless of the circumstances.
I pray I’m wrong but that’s the way I see it turning out.

The jury had to convict Bernie Goetz of something. It was for carrying an unlicensed firearm. He was acquitted of the attempted murder charge.
But as you noted, that was 40 years ago. I’m guessing that a New York jury today is more woke, more entitled, and less working class. I suppose a hung jury is the best we can hope for in the Daniel Penny case.
More likely the jury will decide that Penny just has to be convicted of something. So they’ll find something.

I agree, I also believe his punishment can be just the fact that he had to go on trial and hopefully found not guilty.

OMG, what a typical liberal response, so if someone is threatening you, you would think about it for 30 minutes, before acting.
You would be dead, in two seconds, so much of your 30 minute thinking period of time.
If the jury feels the drugged up bum was a lethal threat then lethal force is acceptable.
Sadly, we’re at the point now, that for the USA to prosper, woke, progressive NY City will need to die.

Exactly like Derek Chauvin and George Floyd, Penny did NOT kill with a knee compression or chokehold
Witnesses testified that Neely was not being "choked," but restrained, and that Neely was breathing after Penny released him.
Chauvin didn’t either as floyd died of a drug overdose
