An appeals court on Tuesday granted a request by prosecutors to drop the case against President-elect Donald Trump for mishandling classified documents.
Special Counsel Jack Smith had asked the court on Monday to dismiss the case because of a long-standing Justice Department policy of not prosecuting a sitting president.
A Trump-appointed district court judge in Florida threw out the documents case earlier this year, but Smith had appealed the ruling to the 11th Circuit Court of Appeals.

Dismissed without prejudice, meaning they can bring up the charges again when he leaves office.
The BS won’t stop until these color of law prosecutors are themselves prosecuted.
I fully expect Trump to test his constitutional power by granting himself a full pardon when this new term expires. That will cause some heads to explode.

Wait a minute. I thought the appointment of Smith was ruled unconstitutional to begin with. How come he has a chance now to prosecute President Trump again in 2029??
Since they requested dismissal wouldn’t that ... or statute of limitations keep from refiling?

Most lawyers have their clients waive their right to speedy trial so they have more time to prepare the defense since they are typically working multiple cases at a time.
Nevertheless, the trial is over. Coming back for more in four years would be with a new indictment, hence new trial.
Who says someone else won't bring an indictment?
Dismissal WITH prejudice means you can't come back for more. This was dismissed without prejudice.
Since they were taking action, they could argue the clock on the statute of limitations would begin the day of dismissal, not the day of the "crime" in question. I don't know if it's 4 years or less though.
