The judge isn't going to dismiss it, and he's also not going to force a state/federal confrontation by trying to imprison a President, because he'd lose that one in the Supreme Court in a heartbeat.
You want to imprison a President, or even a President-elect, the first step must be impeachment/removal from office. So in the case of a President-elect, you'd have to wait.

I would love to see these jerks sentence Trump, then get destroyed for it.
He would show up outside the prison to surrender and say, "If Democrats can do this to me with their lawfare, they can do it to you."
Kathy Hochul wouldn't be able to pardon him and stop the bleeding fast enough.

I am drained by the election. I feel relief, overwhelming relief that we’ve won. Honestly, I’m not taking any of this horrible lawfare seriously anymore. To me, the jury spoke loudly last Tuesday, by thoroughly and completely acquitting Donald Trump of any and all charges.
If this fool of a judge is going to sit there and say Trump must report to jail... well I guess there won’t be any unification then. I’ll revert to being super-angry again and I’m sure everyone else will as well.

If he sentences Trump at all, the sentence will be stayed pending resolution of the full appellate process. The case has so many gross legal flaws that in an actual rule of law, sentencing would be stayed pending appeal, the case would be voided on appeal, and then the case would be dropped.
There was never any basis for this case other than spite and deception.
If New York attempts to arrest and jail President Trump on this preposterous "conviction", the civil war goes hot pretty quickly. Yes, that would mean shooting. A lot of shooting. This one's not going to end well for anyone. I hope the Democrats and their billionaire sponsors are not that short-sighted.

The worst thing NYS and NYC can do is to put Trump in jail because then they would be stuck with the operating costs of the executive branch of the Federal government. Which of course would mean the most intense anal exam of a political organization ever seen in The United States.
The Phony Baloneys of Federal law enforcement who would be scrambling to save their jobs would absolutely destroy NY politics and probably By extension the deep state too.

The conviction occurred before the immunity ruling. Since immunity wasn't considered during the trial and a lot of other garbage was introduced, I can not see where it can move ahead.
I believe Merchan not "will" but "must" dismiss.
