FORT LAUDERDALE, Fla. — The proposed amendments to the Florida Constitution dealing with abortion rights and recreational marijuana are close to passage, a Florida Atlantic University poll released Tuesday found, but both are right on the edge.
Amendment 4, which would enshrine abortion rights in the state Constitution, has support of 58% of Florida voters, with 32% opposed and 11% saying they don’t know.
Though that’s a strong majority, it’s just short of the 60% threshold Florida requires for passage of a constitutional amendment. Winning would require a relatively small share of those who said they still don’t know how they’ll vote to hit 60% — if those voters go all the way through the ballot to the proposed amendments.
Amendment 3, which would legalize recreational marijuana for adults, is faring marginally better.
FAU’s poll found 60% of voters favoring the marijuana amendment, with 34% opposed and 6% undecided.
Fierce campaigns are being waged on both sides of both amendments, as anyone who flips on local TV news and sees the barrage of pro and con ads can attest.
Gov. Ron DeSantis is leading the opposition to both, hoping he can show voters nationwide that he can prevail on major issues in his home state. He’s marshaled the opposition, including spending state government money on advertising opposing the amendments.
Kevin Wagner, an FAU political scientist, said neither amendment is a sure thing. If a simple majority of 50% plus one was all that was required for passage, he said they’d be sure things.
Wagner is also co-director of FAU’s PolCom Lab, a collaboration of the School of Communication and Multimedia Studies and Department of Political Science, which conducted the poll.

So, it only takes a couple percentage points more of the votes to deprice the abortion amendment the 60% threshold it needs.
I actually do not like “popular” (referendum style) amendments to Constitutions - they garner more (too many) less-well informed voters. I remind everyone the original U.S, Constitution was not ratified by a “national popular” vote. It was approved by the legislatures of the states. I also remind everyone when these “popular referendum” style state constitutional amendment methods arose: it was during the “Progressive era”. I do prefer a 60% threshold - in the legislative chambers.
I am afraid many will fall for the liberal lefty wording of Amendment 4. It is totally against the SCOTUS ruling without a doubt. But they’ve worded it so it seems like abortion on demand would be between you and your physician. The average American giving it a quick read would think that too. BUT the words are “your healthcare provider”... meaning abortion clinics, Planned Parenthood, Abortion for Profit the older the fetus the better, for the abortionist.

I believe that a legislative supermajority in Florida is a 3/5 vote, just like in Maryland, so that should be a comfortable threshold for passing an Amendment in each house of the legislature. Then, for ratification, you can have a popular vote, but broken down by counties: if 2/3 of counties (45 out of 67) support the Amendment, then it is considered ratified.

Yep: Any nurse practitioner, physician’s assistant, or other person charged with tending to your health, fixing medical problems and writing prescriptions can perform the “surgery.”
Also, the Amendment apparently says something to the effect that its provisions won’t nullify Florida’s Constitutional right to require parental notification. That one flew over my head, because, as I was informed later, that’s not CONSENT.
In the last election democrats backed off voting (they ran Charlie Crist) on purpose because they wanted to elevate RDS in order to get rid of Trump.
Those people are going to vote this time and people may not like the outcome on these issues.
