AZ Supreme Court rules that votes will count in open primary proposition

The Arizona Supreme Court ruled Friday that votes for an open primary ballot initiative will be tabulated, upholding the trial court ruling that even though almost 40,000 signatures were deemed invalid, any litigation was “moot” as the proposition had already been printed on the ballot.

“We are disappointed in the ruling of the court on this matter,” said Scot Mussi, President of the Arizona Free Enterprise Club. “Our organization proved that the special interest groups attempting to hijack Arizona’s elections systems lacked the minimum number to qualify for the ballot to even be considered by voters in November.”

The Supreme Court ordered the trial court to look at the evidence of duplicated signatures provided by the AFEC, to which the report showed that 99% of the submitted signatures were indeed duplicates.

This is what the courts did to Republicans and Trump in 2020 and 2022. Before the voting, no one had yet been harmed so they did not have standing. Afterwards, the issue was moot because people had already voted.

The Democrats (Marc Elias, et al) have figured this out. Don't ask permission. Go ahead and commit fraud and chances are the courts will excuse it. Or, there is not enough time before the election to do anything. That is why they wait until right before the election to implement new rules and regulations. There is no time to stop them.

All I have seen are “Yes on 140” signs all over the place. There better be some serious signage opposing this pretty quick or we will be californicated.

No need to ask permission when it’s for sale?.

High bidder wins or call in Monte Hall.

The simple ruling since the issue was illegally included on the ballot is it simply does not count, no matter the results. The court’s egregious error makes them accessories to a criminal act.

Once you put liberals or Rino’s on a supreme court, they dig in like parasites and don’t relinquish their power EVER, until death.

So the fraudsters get to keep the prize they got (being on the ballot) even though they got it by fraud?

Same as keepin’ the loot from the bank robbery.

Guess you’d have to be in Frank’s brain to understand that sort of inverted logic.

Probably lotsa Soros cash behind this.

There is very little that can be done at this point

The initiative is already on the ballots and there is not enough time to change

Arizona has traditionally been a strong proponent of clean elections and election integrity, but the system also is based on voter good will and an intent to be responsive to the voting public

Seems the scale has become unbalanced and fraudsters have taken control

Arizona law does not anticipate and deal with outright fraud as well as it should

In this case, massive fraud was involved in getting the initiative on the ballot and there is no time to properly litigate the case before the election

Absent a legal ruling and formal finding of facts, the AZ SC has allowed the initiative to stay on the ballot and votes totaled pending further litigation since there is no explicit finding of fact that the signatures are fraudulent nor any court rulings

The vote totals will probably be made public but the entire initiate will almost certainly be voided after the election via the pending litigation

The chances of this becoming law is close to zero

What it may do is expose the voter fraud that has been creeping into zz elections

Why moot ? I wonder why the judge couldn’t have ruled that any votes for\against wont be counted ?

I would love to see criminal charges brought up against the perpetrators of that fraud

If it passes then there’s a case to render the vote “moot” since it was on the ballot illegally in the first place.

Of course that assumes a fair and impartial justice system in AZ which we do not have.

There is also an opposing proposition on the ballot to this, prop 133. The problem is that the voter needs to understand the issue.

Like I said on an earlier post, the proponents of prop 140 have vote yes signs all over the place. There is nothing countering this. Unfortunately some people vote based on the signage instead of the issue. Its easier to let others think for you.

Jumping the gun. As I understood the composition of the votes, it benefits Rs.

If true, then it means there is literally no chance of this passing.
