Basic, basic stuff that any reasonable attorney knows should’ve left this case in the garbage and never filed.
They should toss out the Alvin Bragg nonsense of a case too

The process is the punishment.
Make him spend millions defending himself, tag him a felon X34 times, constantly attack his lawyers and business associates.............Rinse, Lather, Repeat.........

The courts have plenty of political influence without this naked abuse of power.
I presume the people who sit on the NYS Appellate Division know this.
Legally it would be the right thing to do. But, seeing they are most likely Democrats then I have my doubts.

One might also ask if Tish has pursued anyone else in her kingdom under this novel statute, or if Mr Trump was the only law breaker she wanted.
Not at this level, but it will go to SCOTUS.
How long before they give a ruling?
If they toss it in its entirety, Trump might have the right to sue the state for an unjust prosecution ... my guess is that they will reduce the amount of the penalty to a pittance but allow the case to stand precluding him from suing the state.
People are beginning to realize that the consequences on them when Trump wins the election might be severe.
