Newsmax and Smartmatic settle 2020 election defamation case on eve of trial

The pro-Trump cable channel Newsmax has settled a major 2020 election defamation lawsuit with Smartmatic in a last-minute agreement to avoid a high-stakes trial that posed a significant risk to the small outlet.

“Newsmax is pleased to announce it has resolved the litigation brought by Smartmatic through a confidential settlement,” the network said in a statement Thursday.

CNN has reached out to Smartmatic for comment. The terms of the settlement were not immediately known. The deal comes hours after jury selection got underway in a Wilmington, Delaware, courtroom ahead of opening statements scheduled for Monday. A loss at trial could have put Newsmax on the hook to pay tens of millions of dollars to Smartmatic, putting the small cable channel in financial peril.

“This is a case that is a bet-your-company case for Newsmax,” Howard Cooper, an attorney for the network, said at a recent pretrial hearing.

The settlement is the latest in a string of 2020 election defamation cases to reach an out-of-court agreement before trial. Fox News famously settled with Dominion Voting Systems last year for $787 million, and the far-right channel One America News settled with Smartmatic earlier this year. Both cases were also about the same 2020 election smears.

Newsmax still faces a separate defamation lawsuit over similar claims that was filed by Dominion. Newsmax denies all wrongdoing.

That’s the interesting thing about the discovery phase of a lawsuit. Once the defendant sees the array of evidence that will be presented about their or their company’s actions, settling the lawsuit if much more desirable than throwing the dice and losing the company entirely.

Dominion isn’t likely to settle as easily.

Jovan Pulitzer did a podcast (Rosanne Barr’s) and he went into specific detail on how companies like dominion are able to thwart such cases by use of language and splitting hairs on like NOT having a modem (its integrated) the software is the culprit ...not the manufacturer.

Smartmatic Officers have some issues with bribes in the Philippeans. NewsMax lawyers would have presented this information in front of the Jury making the result uncertain. Better to settle and move on. (This might be posted somewhere else on FR, but I am going out now and lack time to search.)

You’re just asking for trouble when you use computers to count votes. No one trusts the and why should they. Count votes using old school methods. Everyone will sleep better at night when the results come in.

That's all you need to know. Any trial held in Delaware they would have lost and it doesn't matter what the facts are.

We all like to think that there is justice in our system, but the reality is that prejudices are the primary means by which people decide issues.

A trial in Texas they likely would have won, but Delaware? No way.

Exactly. No way they win in Delaware. Delaware is dumb enough to elect Biden, so they aren't all playing with a full deck anyway.

The nation should push Delaware, Rhode Island, Connecticut and a bunch of other little states together and call them a single state. That collection of leftist enclaves should not have so many Senators.

newsmax is working on a public stock offering and prolly needed to clean this up in order to go forward.

Note - this trial was scheduled for delaware, biden’s home state.!! Same thing happened with the Fox lawsuit.
