A three-judge panel ruled 3–0 in rejecting the law, which was passed by the GOP-controlled state Legislature in 2021.
A federal appeals court on Monday ruled in favor of the Biden administration by scrapping a Missouri state law that declared several federal gun laws invalid.
A three-judge panel of the St. Louis-based 8th U.S. Circuit Court of Appeals rejected Missouri’s bid to reverse a lower-court judge’s decision to bar the state from enforcing a 2021 law known as the Second Amendment Preservation Act (SAPA).
U.S. District Judge Brian Wimes in 2023 declared the law unconstitutional. But Missouri, under Republican Attorney General Andrew Bailey, appealed the case.
The decision came in response to a lawsuit filed by the U.S. Department of Justice (DOJ) against the law, signed in 2021 by Republican Gov. Mike Parson after it was passed by the GOP-controlled state Legislature.
“That Missouri may lawfully withhold its assistance from federal law enforcement, however, does not mean that the State may do so by purporting to invalidate federal law,” Chief Judge Steven Colloton wrote in the 3–0 ruling.

FU judge! Come and take it.
Where the hell do the Missouri hillbillies get their Feral judges from? Outhouse Law University and Chicken Ranch?
I don’t recall the part of the Constitution that gives the federal government the power of gun control over citizens and/or states. If it’s not specified than it’s a state power per the 10th.

Something else that needs to be revisited and struck down now that the commies on the court aren’t ascendent.
Legislative takes precedence over judicial, we make the law they enforce what we give them. These black robes need a trim.
They have decreed. Now let’s see them enforce it.
Not a resident, but Missouri should ignore. And if my state passes such legislation (and I hope they would), I’d encourage them to do likewise.
I’d love to hear Justice Thomas expound on Wickard.
L
If Wickard were reversed the exposing heads from the left would make their reaction to the Roe reversal look like little ‘safe ‘n sane’ squibs. Short of repealing the 17th Amendment, reversing Wickard would do a lot to restore American government the way the Founders envisioned it.
The following is the introduction to Justice Thomas' dissent in Gonzales v Raich:
"Respondents Diane Monson and Angel Raich use marijuana that has never been bought or sold, that has never crossed state lines, and that has had no demonstrable effect on the national market for marijuana. If Congress can regulate this under the Commerce Clause, then it can regulate virtually anything–and the Federal Government is no longer one of limited and enumerated powers..."
I can’t remember anything in the constitution about Guns except the 2nd Amendment. And all things not mentioned in the constitution are up to the states. It is kind of hard to seen where this judge thinks he found something unconstitutional. Until the judicial system in the country is cleaned up then we really doomed.
Yes, if only our courts would uphold this amendment, we'd see a great deal of federal law/power revert to the states, which is where it belongs. Probably starting with Lincoln, we've see the 10th amendment ignored for political advantage and power. We are not being governed as our Founders and Constitution intended.
