Former President Donald Trump has informed the federal government that he intends to sue over the FBI’s raid of Mar-a-Lago in August 2022, alleging it was conducted to interfere with his 2024 election bid, Fox Business reported on Monday.
Trump’s legal team is threatening to sue for $100 million, alleging the federal government is guilty of invasion of privacy, malicious prosecution, and abuse of process. The unprecedented raid of Trump’s estate took place just a year and a half after he left the White House and resulted in Attorney General Merrick Garland appointing special counsel Jack Smith to go after Trump over his handling of classified documents.
Judge Aileen Cannon dismissed the classified documents case against Trump last month after ruling that Smith’s appointment was unconstitutional. Trump’s lawyers argue that the federal government’s goal for the Mar-a-Lago raid was to stop Trump from running for the White House in 2024.
“That’s what President Trump believes the entire special counsel investigation was about, interfering with his ability to get elected,” said Daniel Epstein, counsel to the former president. .....
Trump’s lawyers are pointing to internal FBI emails that allegedly show agents questioning whether they obtained the required probable cause to proceed with the raid on Mar-a-Lago, Fox Business reported. Less than a year after the raid, House Judiciary Chairman Jim Jordan (R-OH) revealed that Steven D’Antuono, the former assistant director in charge of the FBI’s Washington Field Office, “expressed strong concerns with the Department’s pursuit of the raid and noted several unusual features in the Department’s handling of the case.”
The lawyers argue that Garland should have known that as a former president, Trump would have immunity from prosecution over his handling of the classified documents in question and that Smith could not be appointed special counsel.

When you sue the federal government, federal law requires that six months before you file your lawsuit, you have to serve a Notice of Intent to File with the DOJ. This lays out how much you're asking for & why. It gives the feds a chance to settle out of court with you. (Or destroy all the incriminating evidence against them. It depends on how cynical you are.)
Timing is everything. If Trump gets sworn in on January 20, the new AG will have about three weeks to approve the $100 million settlement. Then Trump can distribute the $100 million as he chooses. Perhaps he'll start a Trump Foundation, that provides low-interest loans to conservative truth tellers like Daily Wire or Free Republic. Just a thought. Let's see what you think.
Also, Trump had immunity anyway under the Presidential Records Act. The strange thing is that in is entire indictment, Jack Smith didn't even mention the PRA. He pretended it doesn't even exist. This is why former President Trump could have classified docs, but former Senator/VP Joe Biden couldn't -- and why Biden was breaking the law, when Trump wasn't.
Oh, by the way: If he wins the election, the new AG just writes him a check for $100 million. If he loses the election, he files a lawsuit in Palm Beach & gets Judge Aileen Cannon again. And a jury full of white Republicans.
I hope he wins bigly.
He should sue for $564 million or whatever that judgement agahim was.
Discovery could be interesting. If the corrupt judges allow it to get that far.
That a just for the raid. Not to mention violation of his civil rights and laws yer fees for Fulton, DC trial, and NYC trials.
So do I.
Donald should sue for one billion dollars.
Good, and $100 million seems to low!
why only 100 million? 500 million to at least break even on his fines!
He should leak the message that he has whistleblowers lined up ready to testify, and then just stand back and let them self-destruct.
