Heritage Foundation Vows to Make ‘Extraordinarily Difficult’ to Replace Biden on the Ballot

The Heritage Foundation vowed Wednesday to make it “extraordinarily difficult” for Democrats to replace President Joe Biden on the ballot.

“If the Biden family decides that President Biden will not run for re-election, the mechanisms for replacing him on ballots vary by state. There is the potential for pre-election litigation in some states that would make the process difficult and perhaps unsuccessful,” Heritage Oversight Project stated in a memo that was compiled in April and released last week ahead of President Joe Biden’s “disastrous” debate performance.

Heritage Oversight Project Executive Director Mike Howell, who authored the memo, said that replacing Biden would be “extraordinarily difficult” and that they would ensure it would make it “extraordinarily difficult” to replace the 46th president on the 2024 ticket.

Does Biden have to be removed by the 25th amendment in order for Kamala to step in?

No. Choosing a candidate is a party function, not a state or federal function. But a Kamala replacement candidacy might have to overcome state election law deadlines.

That being said, it might be good to have her replace 'Out-to-Lunchbox' Joe and get creamed in the election to ensure that she is finished in politics.

Not if he decides to step down. The question is, if indeed he decided not to run, I'd have to wonder if the decision was actually his.

Here is how I see it playing out that avoids early court intervention and can be controlled completely by the Dem party:

1.) Many of the states’ delegates are obligated (by law) to vote for Biden
2.) He wins the nomination on the first ballot
3.) He declines the nomination (from a backroom deal) sending everyone into apoplexy.
4.) the Dems are now obligated to nominate a new candidate (from the same backroom deal) which may or may not involve V.P. Harris.
5.) The replacement candidate is chosen.
6.) Then they have to go to court to get the candidate on the states’ November ballots.

Great post. I believe the legal issue related to the 2024 nomination process will come down to individual state laws that govern their primary processes.

I do think that those states that have a requirement for some form of certified infirmity to be removed from the ballot would accept a 25th amendment discharge of power as acceptable proof of infirmity.

This may be an end-game tactic that they're holding on to as an "in case of emergency" maneuver. They're just not ready to break the glass on it yet.

Besides that, the Dems rigged their system so RFK Jr couldn’t run as a Dem, and other crediible Dem candidates got the message and stayed out. They created this system, let them choke on it.

For what it is worth, Biden is not removed by the 25th anendment. He is still the President of the United States. The 25th amendment merely removes and transfers his powers. The only way to remove a president against his will is by impeachment in the house and conviction in the senate by 2/3 of the majority sitting

That’s what I’ve been wondering. Any candidate might die naturally a few days before an election, and the states would deal with it. Biden stepping down doesn’t mess things up any more than his death would.
