Who's behind the Supreme Court attack on the 'administrative state' | Opinion (barf)
Alternet ^ | July 1, 2024 | Robert Reich

Posted on 07/01/2024 4:40:25 PM PDT by where's_the_Outrage?

For years, conservatives have railed against what they call the “administrative state” and denounced regulations.

But let’s be clear. When they speak of the “administrative state,” they’re talking about agencies tasked with protecting the public from corporations that seek profits at the expense of the health, safety, and pocketbooks of average Americans.

Regulations are the means by which agencies translate broad legal mandates into practical guardrails.

Substitute the word “protection” for “regulation” and you get a more accurate picture of who has benefited — consumers, workers, and average people needing clean air and clean water.....

Make no mistake: Consumers, workers, and ordinary Americans will be hurt by these decisions. Big corporations — especially their top executives and major investors — will make even more money than they’re already making because of them.

Robert Reich, Clinton crony.

Might have worked if these agencies just targeted corporations, but they target normal people with wetlands, fines, oversight, etc.

“ Substitute the word “protection” for “regulation” and you get a more accurate picture of who has benefited”

Substitute the word oppression and you get a more accurate picture of the role of unelected officials

“ Regulations are the means by which agencies translate broad legal mandates into practical guardrails”

If we need an administrator to explain the law, they didn’t do it right. But the Democrats took advantage and said, it’s our playground now and we make the rules. So it’s our way or the highway. We’ve been suffering ever since they discovered this goldmine of underhanded lawmaking.

Reich is a filthy commie. The administrative state is why we can’t build anything anymore. The army of Lilliputian bureaucrats are not experts. They commies

if you want “protections” you convince congress to pass a LAW and the president to sign it, you don’t just make it up and dictate it!!!

For my FReeper Family that need to debate the Chevron decision with friends, family or random, retarded liberals, here is a great Tweet which explains it all in great detail:

For those who don't understand what Chevron Deference is, and why SCOTUS ended it, here's the long and short of it: A family fishing company, Loper Bright Enterprises, was being driven out of business, because they couldn't afford the $700 per day they were being charged by the National Marine Fisheries Service to monitor their company.

The thing is, federal law doesn't authorize NMFS to charge businesses for this. They just decided to start doing it in 2013.

Why did they think they could away with just charging people without any legal authorization?

Because in 1984, in the Chevron decision, the Supreme Court decided that regulatory agencies were the "experts" in their field, and the courts should just defer to their "interpretation" of the law.

So for the past 40 years, federal agencies have been able to "interpret" laws to mean whatever they want, and the courts had to just go with it.

It was called Chevron Deference, and it put bureaucrats in charge of the country.

It's how the OHSA was able to decide that everyone who worked for a large company had to get the jab, or be fired.

No law gave them that authority, they just made it up.

It's how the ATF was able to decide a piece of plastic was a "machine gun".

It's how the NCRS was able to decide that a small puddle was a "protected wetlands".

It's how out-of-control agencies have been able to create rules out of thin air, and force you to comply, and the courts had to simply defer to them, because they were the "experts".

Imagine if your local police could just arrest you, for any reason, and no judge or jury was allowed to determine if you'd actually committed a crime or not. Just off to jail you go.

That's what Chevron Deference was.

It was not only blatantly unconstitutional, it caused immeasurable harm to everyone.

Thankfully, it's now gone.

We haven't even begun to feel the effects of this decision in the courts. It will be used, for years to come, to roll back federal agencies, and we'll all be better of for it.

And that's why politicians and corporate media are freaking out about it.

Riiight, so when the EPA was going to ban gas stoves, that helped consumers? The draconian gas mileage requirements by the EPA to auto manufacturers helps consumers?

But let’s be clear. These agencies were set up under the guise of helping the public and private businesses to work with the government. They’ve naturally evolved into oppressive government entities with no constitutional authority. PISS ON ALL alphabet agencies.

When people don’t like a provision of the Constitution we have a way to amend it.

When people don’t like a law or court ruling, we can change them through legislation by ELECTED representatives.

It’s a novel concept called “government by consent”. Folks on the left might want to look into it. It’s pretty neat.
