The Supreme Court will be issuing Opinions at 10:00 a.m. this morning for the October 2023 term. You can read the opinions released thus far at Supreme Court opinions.
The attorneys at scotusblog will be liveblogging the release of opinions from the pressroom.
There are four cases remaining undecided for the October 2023 term.
October sitting: All opinions have been released;
November sitting: All opinions have been released;
December sitting: All opinions have been released;
January sitting: All opinions have been released.
February sitting: There are three cases pending.
Corner Post v. Board of Governors of the Federal Reserve System, (an Administrative Procedure Act issue), and the two First Amendment cases. Moody v. NetChoice, LLC, and NetChoice, LLC v. Paxton.
March sitting: All opinions have been released.
And then there is the case we are all waiting for from the...
April setting: There is one case remaining undecided.
Which is the case of Trump v. U.S., No. 23-939 [Arg: 4.25.2024]
Issue(s): Whether and if so to what extent does a former president enjoy presidential immunity from criminal prosecution for conduct alleged to involve official acts during his tenure in office.

The problem with your scenario is that the DC trial court already ruled that Trump was not immune, as did the appeals court. It seems a ruling along the lines you suggest would mean the DC trial can resume forthwith.

So, two boxes which probably means all 4 Opinions (2 combined).
And if those public actions are subject to litigation post-presidency, then there really isn’t immunity, as all one has to do is wait out the term(s) of office.

Nothing against you or your post, but I got enough of those 2 words strung together in the “debate” to last for many years.
Since immunity isn’t spelled out in the Constitution, I think they’ll rule no immunity, but kick it back to the lower appeals to start deciding what level of immunity is appropriate.
Roberts wants to write the Trump immunity opinion so he can boast that he wrote it.
I expect at least 3 concurring opinions. Could be a unanimous decision in order to present a unified court opinion.
Will be interested to see if the opinion addresses Jack Smith’s unconstitutional and unlawful appointment.

It is 6-3, with Jackson dissenting joined by Sotomayor and Kagan.

The court holds that a claim under the Administrative Procedure Act to challenge an agency action first comes into being when the plaintiff is injured by final agency action.
This was a challenge to a Federal Reserve Board rule that was issued well before the plaintiff in this case, a truck stop and convenience store in North Dakota, opened for business.

I would think this means that Barrett does not have the First Amendment cases.

The government argued that the six-year statute of limitations had already passed and Corner Post could not challenge the rule, but the court today holds that because Corner Post filed its challenge within six years of when it was injured by the rule, its challenge was not barred by the statute of limitations.
Justice Barrett started her announcement with a joke about how this case was not one that we were here to hear.
Justice Jackson calls the “flawed reasoning and far-reaching results of the Court’s ruling in this case” “staggering.”
She writes that “there is effectively no longer any limitations period for lawsuits that challenge agency regulations on their face.”
IMHO, Jackson is too ignorant to be on the Court.
