Chip Roy on X ^ | 6/28/24

Posted on 06/28/2024 6:44:45 AM PDT by hole_n_one

I intend to put forth a resolution calling upon the @VP
to immediately use her powers under section 4 of the 25th Amendment to convene & mobilize
the principal officers of the Cabinet to declare the @POTUS
is unable to successfully discharge the duties and powers of his office.

Chip Roy should really read the 25th Amendment carefully - it is very difficult to remove a President who doesn’t want to go by using the 25th. Here is the process that has to be followed:

First, the VP and a majority of the Cabinet must declare that the President is unable to fulfill the duties of his office. If the President disagrees, all he has to do is inform the Speaker and president pro tem of the Senate that no such disability exists, and he resumes the duties of his office.

In that case, the VP and the Cabinet can inform the Speaker and the president pro tem AGAIN within 4 calendar days that the president cannot perform his duties. Congress must then meet within 48 hours to determine the matter. If they do not vote by a 2/3 majority in each house that the president cannot perform his duties, he resumes his office and duties. The decision must be made by Congress within 2 calendar days of when they are notified by the VP.

So if they try to invoke the 25th Amendment and Biden disputes it, they would need a supermajority of both houses to remove him.

4th Article of 25 Amendment says it must be a majority of Executive Branch (ie Cabinet)

The VP must invoke the 25th...

~~~
I didn’t know the VP was the only one who could invoke it.
That puts an enormous amount of pressure on the VP. If you are going to invoke it, you had better be absolutely sure you’re going to get the cabinet (and congress?) to agree with it. If you don’t get it, the sitting president could characterize it as a failed coup, and then you, and your future political career, have big problems.
The amendment requires the majority of the cabinet and the VP. I don’t think there’s anything that requires the VP go “go first” as it were, but if the majority of the cabinet is on board, the VP then has the sole choice whether to go along or not.
Air Force One has a great scene on this actually.
I assume the VP would not attempt to invoke the 25th by herself since majority of cabinet must agree. Lots of closed door meeting, which actually does sound like a coup.
“The decision must be made by Congress within 2 calendar days of when they are notified by the VP.”
Sorry, that should have said within 21 days, not 2 days...
If the invocation of the 25th occurs, could the Republicans find a way to defeat it?
Sure. If Biden contested it and it went to Congress, it would only take 144 congressmen or 34 senators to defeat it. It is actually MORE difficult to remove a president who doesn’t want to leave by using the 25th Amendment than by impeachment. You only need a majority of the House to impeach, though you need 2/3 of the senators to convict. To remove a president via the 25th Amendment, you need 2/3 of each House to agree.
Will a 25th Amendment action provoke a Constitutional Crisis (based on the ineligibility of Kamala Harris to assume the Presidency)?
Let the Demonicrats invoke the 25th. The Republicans should then force the Demonicrats to explained for the record exactly why they are doing so.
EXACTLY!!!
She will never get a VP past congress. So, over 6 months, she would be asked to put on her big girl panties and lead the country, start a non-existent presidential campaign, and fend off a half dozen other snakes before the convention ... all while not having a tie breaking vote in the Senate and having to face DJT.
Well it would get the 2nd “Mrs. Wilson”— Jill Biden out of the picture, that’s for sure. The succession without a replaced VP possible, would be Speaker Johnson.
If he didn’t contest it, then he would be removed. But if he would not contest it, why wouldn’t he just resign and avoid the embarrassment of being removed?
And again I point out that if the Republicans 25th Amendment OBiden out of office, he obviously didn't just this minute go off the deep end, which brings to question how many of his decisions as POTUS might have been made while he was non compose mentis. So by not forcing him to resign, the demoncrats potentially are risking every last decision OBiden has made as president. Every bill he signed and every EO he wrote. His entire term in office could be erased.
