Foxx plan to ditch evidence found during traffic stops would be ‘devastating,’ former police chief says {Chicago}

Police traffic stops have become a hot topic lately, with critics claiming that Chicago police disproportionately stop Black and Brown drivers for minor infractions, intending to turn the traffic violation into a vehicle search that could turn up guns or drugs.

Some say that the stops are fishing expeditions.

Cook County State’s Attorney Kim Foxx is one person in that camp. Last month, she announced that she is formulating a policy that could result in her office not pursuing gun and drug cases that result from “pretextual stops,” traffic stops conducted by police intending to look for evidence of other crimes.

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

The Fourth Amendment applies to all citizens equally.

Police do not have a right to search your car because you have a cracked taillight. They must have a reasonable articulable suspicion and provide you with that suspicion.

“Go get a warrant. I’ll wait.” Make sure that whoever swears out the warrant under oath can describe exactly where the contraband you’re looking for is located. It is not within your authority to tear my car apart hoping to find something.

And if you do tear it apart, you’re darn sure putting it back together again.

Agreed. However, it could be also that a.) black and brown skinned people are not in the minority where the stops are made, b.) that they reek of marijuana or alcohol, or cannot provide identification, leading to c.) cause to investigate, during which d.) contraband is found on their person. Just not believing cops think “Hey, there’s a black guy. I think I’ll go put my life on the line to search his car, just to see what I find.”

Yours is an important viewpoint. Too many cops act as if the Constitution doesn’t exist. And they will casually lie and escalate.

On the other hand, too many “progressive” politicians want to cripple the police.

Some sort of balance is needed. And I would suggest that the police take first step. When the public has trust in the police, the progressives can gain no traction.

It’s rare, but it does happen. And when it does, the victim tells his family. And they tell others. And so the public’s trust in the police is eroded even further.

A municipality near me made a habit of that. Their cops had an innocent-sounding code phrase they’d say on the police radio when a black driver was spotted in their jurisdiction.

And so the car was followed. Any minor infraction - real or imagined - would get the car pulled over. Then came the “I smell the odor of marijuana” and a search. All this came out only after one of the cops beat up one of the drivers.

Don’t get me wrong. I’m not talking about all cops. A few bad ones, however, can ruin the reputation of the entire profession.

Reining in cops that use pre-text stops to search vehicles?
I’m all for it.

Stop me for speeding, write my ticket and send me on my way.
Don’t make small talk.
I won’t answer your questions.

If you say you smell anything illicit coming from my car, I’ll ask you for your morning’s “nose calibration certification”.
Because I’m certain there isn’t anything illicit in my car.

I do believe pre-textual tarry-stops are a violation of rights.
Sometimes. even the most self-serving politician does something worthwhile.

I beleive Foxx is the same woman who refused to prosecute 2 rival bang members who shot at each other in stopped traffic, a person was murdered, plenty of video showing the whole thing p,us eyewitness account from an off duty cop

Her excuse was “it was mutual combat” and “there isn’t enough evidence to get a conviction.

Lo4i Lightfoot of all people was stunned by her refusal to prosecute

I got pulled over the other day for a minor license plate violation. The trooper told me he was recording me.

That’s OK, I was recording him too.

Always record the police.

DAs that won’t enforce the law as written need to be immediately evicted from office, barred from ever holding office again and imprisoned for no less than 2 years.

If they don’t like the law then they can run for legislature and CHANGE it. You don’t get to pick and choose what laws “count”

Typically making the stop and then seeing the firearms or drugs sitting on the dashboard or some such. Not a "search" as such.

Presuming the same demographics of Chicago cops in general, mostly black these days. This is true also at the top level. White cops tend to be older guys hanging on for retirement.
