Here’s What Could Happen If Trump Is Found Guilty in the Stormy Daniels Case

It’s true that Trump has been charged with a non-crime and that Manhattan District Attorney Alvin Bragg’s case against Trump has been severely undermined by his own witnesses. In fact, several Democrat experts have said Trump could be acquitted because of how bad some of the prosecution’s witnesses have been for the case.

But between the partisan jury and Biden donor Judge Juan Merchan’s jury instructions, it seems likely that Trump will be found guilty.

So the question is: what happens if the jury returns a guilty verdict?

According to conservative radio host Mark Levin, in the event of a guilty verdict, Trump could seek a direct appeal to the Supreme Court.

“I asked my friend of nearly 45-years [sic], Arthur Fergenson, who served as a law clerk to the late chief justice, Warren Burger, and one of the smartest lawyers I know, if he represented President Trump how he might seek a direct appeal to the Supreme Court if necessary,” Levin wrote in a post on X/Twitter. 

Levin posted Fergenson’s reply.

The US Supreme Court can act by its statutory writs of certiorari to take a case from a lower appellate court, and the Court also has a host of other processes, often called common law writs. I became acquainted with these common law writs (actually authorized as a general matter by the Judiciary Act of 1789: law.justia.com/constitution/u… ), when IBM sought review of a discovery order by a vindictive federal judge when I was clerking for Chief Justice Warren Burger. A total of six petitions were filed; all were denied, and rarely are any common law writs ever issued by the Supreme Court, but there are, nonetheless, multiple ways to offer the Supreme Court an opportunity to forthwith review

The federal judiciary ended up pulling that "judge" [David N. Edelstein] off the IBM case because of the total embarrassment he had become.

All the recent screaming now from Raskin and other demoncrats about the evil Supreme Court - is a preemptive attack to freeze the SC in the event of a Trump immediate appeal to the SC.

The demoncrats are evil liars but they know they have corporate news on their side. I.e., we will hear little push-back from them on the lying diatribes of Raskin, et al.

With all that's arrayed against him, it's a miracle that Trump is still with us.

No doubt Fidel Merchan would issue an order barring Trump from doing so.

He can, in the sense that he can write that down and issue it, but it's meaningless. If you can appeal the finding of a court, it inherently means you're asking the appeal court to override the finding of the trial court. Obviously a court can't bar someone from appealing or they could just do that every single case.

A guilty verdict very well could increase turnout among Trump supporters, and that could be the key. Imagine if 99% of Trump supporters voted and only 80% of Biden supporters in a scenario where they are polling even.

Don't think he can bar who DJT choses to appeal to. Once his case is Stalined, it's out of his hands. Trump appeals as he wants anyway.

its New York - they have pre-arranged a corrupt judge, have found 12 woke NY idiot jurors - Trump WILL be found guilty.

Like “impeachment” it was all manufactured for headlines and photo-ops with a constant threat of “jail” hanging above Trump.

It would sound “huge and serious” at first, but for most Americans it will become just another dull milestone on the highway of corruption of American institutions.

This moron’s appeal ended right there.

This disgusts me about Republicans or folks who are supposed
to be on our side.

Trump is not guilty and should be found not guilty, no
gray area at all.

The jury will not be justified no matter what ruling guilty.

There’s no process to appeal from a state court other than the highest court of the state to the Supreme Court. End of Story.

See 28 USC 1257:

“a) Final judgments or decrees rendered by the highest court of a State in which a decision could be had, may be reviewed by the Supreme Court by writ of certiorari where the validity of a treaty or statute of the United States is drawn in question or where the validity of a statute of any State is drawn in question on the ground of its being repugnant to the Constitution, treaties, or laws of the United States, or where any title, right, privilege, or immunity is specially set up or claimed under the Constitution or the treaties or statutes of, or any commission held or authority exercised under, the United States.”

Wouldn’t this open the door to prosecute Bill Clinton, Joe Biden and countless other politicians who currently hold office??

I seriously doubt this could result in a guilty burden. It’s possible, but jurors are necessarily the tools some people think they are.
