SOP in personal injury litigation. Insurance appointed defense counsel always assert an affirmative defense that alleges the plaintiff is responsible for their own injuries in whole or in part. I would not read too much into this.

Will never forget the lawyer for a child rapist stating that his client was facing cruel and unusual punishment for his jail time because he had aids and would die in prison.
Nevermind the fact his victim a 4 year old girl whom he was babysitting and he raped giving her aids of which she had died of.
To the legal system this is considered completely “ethical” behavior..
