(a) It shall be unlawful for any alien to vote in any election held solely or in part for the purpose of electing a candidate for the office of President, Vice President, Presidential elector, Member of the Senate, Member of the House of Representatives, Delegate from the District of Columbia, or Resident Commissioner, unless—
(1) the election is held partly for some other purpose;(2) aliens are authorized to vote for such other purpose under a State constitution or statute or a local ordinance; and
(3) voting for such other purpose is conducted independently of voting for a candidate for such Federal offices, in such a manner that an alien has the opportunity to vote for such other purpose, but not an opportunity to vote for a candidate for any one or more of such Federal offices.
(b) Any person who violates this section shall be fined under this title, imprisoned not more than one year, or both.
(c) Subsection (a) does not apply to an alien if—
(1) each natural parent of the alien (or, in the case of an adopted alien, each adoptive parent of the alien) is or was a citizen (whether by birth or naturalization);(2) the alien permanently resided in the United States prior to attaining the age of 16; and
(3) the alien reasonably believed at the time of voting in violation of such subsection that he or she was a citizen of the United States.

I was thinking that this would require two distinct ballots. one for aliens that does not included fed offices with just the locals and one with everything.
The penalty is spelled out in (b) - fine and/or 12 months in prison.
Also, correction to my summary of the first condition:
If one parent then that parent must be a citizen. If 2 parents, then BOTH must be citizens.
As I read this provision, it doesn’t say that aliens may vote for federal office holders. It merely provides the conditions under which aliens may vote for state office holders in “elections” where federal offices are also being voted. The enactors most certainly did intend to allow illegals or resident aliens to vote in federal elections.

Yup, there must be some mechanism by which the federal offices are voted for separately such that aliens are demonstrably and provably excluded from that vote.
I am inferring the conditions “demonstrably and provably” since otherwise lawsuits would be filed and would likely succeed (except in blue cities of course, but they would not skate easily IMHO without some pretext of accountability. Even Hitler and the Nazis bathed in their self-justifying and delusional rules and procedures for murdering 8 million Jews and thousands of other enemies).

Everyone knows whether or not he is a citizen. There’s no such thing as “reasonably believes”. That’s like saying “I reasonably believe I’m the savior of the world.”

So, you are, practically speaking correct, but technically incorrect.
In a more normal world, say in 1987, I would not have a huge problem with the child of citizens voting, but one would want to ask why that child had not already become a citizen? That would render this whole law certainly less consequential or negligible in affecting any election outcome.

There’s a certain amount of reasonableness that comes into play.
These people are told to come to the U.S., told they’ll get amnesty, just apply for asylum.(nevermind how the asylum system is being massively abused, that is its own huge topic)
They come here, under asylum, they get all sorts of free goodies and most importantly, they get a driver’s license. (Enter Motor Voter)
Come election season, someone who is here as a migrant under asylum, ostensibly they’re still an illegal alien, now receives a voting ballot by mail.
Reasonably, this person has a reason to believe in good faith mind you, that they are a citizen. Why would any government send an election ballot to an illegal alien??? No other government does this. So I must be a citizen now.
Any poorly executed defense in court could get this guy off of all charges. He would vote, and he would walk free of all charges out of the courtroom based on this U.S. Code. And nevermind poorly executed defenses, those fighting to bring in illegals are heavily bankrolled and employ very good/slick lawyers.

Agreed, and the condition as written means that the alien must demostrate some reasonable basis for the belief that the alien is a citizen. A mere declaration is not such a basis.
Even Jesus Christ did not rely on His assertion, but demostrated under Mosaic, contemporaneous Roman, and even physical laws that He is the Messiah.
Ergo, we have demonstrable reason to believe Him to be One and The Same, even after so many centuries.

Having said that, relying on false information is not a reasonable basis for a belief, since the basis is unreasonable.
Again, evil will scorn good, but the malicious and eristic arguments of the damned are not redeemed and somehow magically imbued with reason just because someone says they relied on them. That is among the resons for the left to argue that logic is racist. Nonsense, of course, since they are using logic to decry logic, but then, this madness has become a hallmark characteristic of the first quarter of the 21st century.

Someone in the House majority needs to write and have passed a bill early on in the next Congress in 2025 reaffirming these relevant laws and adding that no person entering the US illegally shall ever be granted a path to citizenship.
You may be right, but as pride goeth before the fall, it may just be the case that not all of the illegals are progressive leftist Columbia University students who buy into all of the leftist nonsense.
Maybe, just maybe, they have miscalculated. Maybe the illegals ultimately will act in their own self interest as inividuals, and not as a collective. I believe that individual liberty, while codified into our documents, is not a unique aspiration of mankind, and is, in fact, the mechanism of the “melting pot.”
This, I believe to be the Achilles heel of the left. Yes, it may be very painful, and we may be casualties of the fight, but, I am more optimistic than not about how this battle resolves itself. At the very least, I believe the leaders will be consumed by the monster they create.

Perhaps the most helpful response! It is ridiculous to think election corruption can be eliminated by chasing individual voters one at a time.
The cited statute provides voting by aliens is unaffected if it is done: in such a manner that an alien has the opportunity to vote for [local issues], but not an opportunity to vote for a candidate for any one or more of such Federal offices.
With that, (J6) Special Sessions should reject state certificates where voting aliens were given any ballot that included federal offices.

As with any law made by the unconstitutionally big, post-17th Amendment ratification federal government, patriots first need to go upstream to the Constitution to find a clause that reasonably justifies the law. And if there is no clause, then patriots have a constitutional duty (imo) to replace the entire House and whatever senators are up for reelection in the next election, November 2024 a great time to start doing so.

Patriots desperately need to fire post-16th Amendment (16A) ratification career celebrity lawmakers who chase the tsunami of unconstitutional federal taxes fostered by the abuse of that clause, taxes that Congress cannot reasonably justify under its constitutional Article I, Section 8-limited powers.

Regarding voting by aliens, note that women couldn't vote in states that prohibited women from voting until after the 19th Amendment (19A) was ratified.
"19th Amendment: The right of citizens of the United States to vote shall not be denied or abridged by the United States or by any State on account of sex.
Congress shall have power to enforce this article by appropriate legislation."
And for states that think that they can simply allow illegals to vote like they let women vote before 19A, consider this. The congressional record shows that post-Civil War lawmakers had expressed concern that states that allow non-citizens to vote effectively nullify the Constitution's "Uniform Rule of Naturalization Clause."
"Article I, Section 8, Clause 4: To establish an uniform Rule of Naturalization [emphasis added], and uniform Laws on the subject of Bankruptcies throughout the United States;"
" If the States can admit to the elective franchise those who are not citizens, thereby neutralizing the votes of citizens, not only the Federal power of naturalization becomes a nullity, but" * * * * "a minority of citizens by the aid of aliens may control the government of the States, and through the States the government of the Union [emphasis added]." —Appendix to the Congressional Globe, 1868. " Whatever difference there may be as to what other rights appertain to a citizen, all must agree that he has the right to petition and also to claim the Protection of the Government. So OBiden must first lead Congress to successfully propose an illegal aliens voting rights amendment to the Constitution before illegals can vote to keep desperate elite Democratic and RINOs in power imo, such an amendment effectively repealing the relevant part of the Uniform Rule of Naturalization Clause. But it isn't going to happen imo.
Who will actually enforce the law? On top of that, each case will have to be tracked down individually.
