Biden dismantles Trump-era Title IX rules, sidesteps issue of trans athletes in girls' sports

The Biden administration has unveiled new rules aimed at safeguarding LGBTQ+ students and changing the ways in which sexual harassment and assault claims are adjudicated on campus.

The new provisions are part of a revised Title IX regulation issued by the Education Department, fulfilling a campaign pledge by President Biden to revamp those issued during the Trump administration.

Missing from the new rule, however, is a policy forbidding schools from enacting outright bans on transgender athletes competing against biological females.

The Biden administration was widely expected to bring in such a policy but has instead put the provision on hold. The delay is widely seen as a political maneuver during an election year in which Republicans have rallied around bans on transgender athletes in girls' sports.

Under the new rules, sex discrimination includes discrimination based on gender identity as well as sexual orientation. A school must not separate or treat people differently based on sex, except in limited circumstances, under the provisions and critics say that the change will allow locker rooms and bathrooms to be based on gender identity.

LGBTQ+ students who face discrimination will be entitled to a response from their school under Title IX, and those failed by their schools can seek recourse from the federal government.

Biden is also officially undoing sexual assault due process rules put in place by his predecessor and current election-year opponent, former President Donald Trump.

Colleges will no longer be required to hold live hearings to allow students to cross-examine one another through representatives. Instead, college officials will be able to interview students separately, allowing each student to suggest questions and get a recording of the responses.

In evaluating the parties’ evidence, a school must use the "preponderance of the evidence" standard of proof...

I'm sure this is exactly the kind of the thing the Founding Fathers had in mind when they created the office of the President at the Constitutional Convention.

It seems the only safe place for a male student who doesn't want to be the victim of a false accusation by a female student is to attend an all-male college, but there aren't many of those left.

They are traitors to women just like when Bill Clinton was accused of chasing the interns in the Oval Office and they said nothing.

There is only one way to stop this madness, an Executive Order by President Trump that ALL PUBLIC EMPLOYEE’S and OFFICERS OF THE COURT NATIONWIDE be required to send their minor children to the Public School System or the Children get Removed from the Family Home and put in to Foster Care for their own protection.

They didn’t say nothing. They said specifically they were more concerned about his Supreme Court picks than his personal life. In other words, let us kill babies and you can ‘rape’ whatever interns you want.

Definitely not a good time for the left. But that didn't stop them and the hypocrisy continues. They ignore it but we notice.

If they are legit they'd be screaming misogyny and sexism while dudes pretending to be women defeat women in women's sports.

I recall one so called feminist said of Bill Clinton, that he can have a free grope, the implication being that there should not be a zero tolerance policy when it comes to favored Democrat politicians who have committed these transgressions

Notice the Congressional hush money fund - taxpayer dollars - to settle sexual harassment cases hasn’t been made public.

Trump on trial for that.

Dems though now post #me too are getting kicked out by the mob as well. Al Frankin etc.

I don’t get it. I know progs are pushing this trans stuff, but if everyone in the country changed genders there would still be roughly 50% males, and 50% females. What would have been accomplished?

So basically scuttling any due process rights for the accused in cases of allegations of sexual misconduct as well as not even being able to say if a victim is actually a woman or a man. Good going.

SCOTUS has already ruled Only CONGRESS CAN MAKE OR PASS LAWS. Agencies cannot make and enforce rules - it must be by Congressional approval only.

Why is even promoted by the Biden Admin. It is not enforceable.

But you forget that DemocRat EOs are un-reversable. Trumo tried to reverse the Obama DACA EO, which evenb Obama admitted was unconstitutional, but the SC ruled that he had no authority.

It is true that only Congress together with the Senate and President’s signature can make and pass laws. Agencies and the President via Executive Order (if they comply with the APA laws) can only make rules on issues that are set forth in the respective agency’s enabling statute which is passed by congress and the senate and which was signed into law by a President. However, no law or rule can ever override the US Constitution and/or the current interpretation of the applicable Constitutional article, amendment or clause by the SCOTUS.
