Supreme Court allows Texas to enforce immigration law

WASHINGTON — The Supreme Court on Tuesday allowed Texas to enforce a contentious new law that gives local police the power to arrest migrants.

The conservative-majority court, with three liberal justices dissenting, rejected an emergency request made by the Biden administration, which said states have no authority to legislate on immigration, an issue the federal government has sole authority over.

What? Posse Comitatus restricts the use of the military to enforce “civilian” laws. Can’t have the 82nd Airborne setting up speed traps on route 12, and that kind of thing.

To suggest that the US Army can t secure the southern border is lunatic leftist twaddle.

It may come as a surprise to some, but the US Army has a long history in protecting the border. Is it your contention we can deploy troops to say, Afghanistan or Iraq without a formal declaration of war, yet we can’t deploy troops to protect our own country from invasion?

With all due respect, either you are crazy, or the judiciary is, Or Leftists, etc.

It was stayed by Alito “pending further orders.” This is the further orders.

This isn’t exactly a win - this is allowing the status quo until the 5th Circuit can weigh in or the Bidenistas appeal to SCOTUS and it is heard there.

Here’s a comical scenario. Mr. illegal Sancho Tortillarojo buys a gun at a store in Texas. He leaves the counter and a Texas officer arrests him. Oh it’s ok to have the weapon, but since he’s here illegally, well he’s under arrest. He can have the gun back when he gets legal citizenship.

The Biden Administration is likely to lose at the 5th Circuit, at which point they will appeal (and appeal, and appeal, and appeal as they usually do) all the way to SCOTUS. Everyone knows it - the Obama Admin did the same thing with Arizona SB1070 - the big difference this time is that instead of enforcing Federal law, Texas will be enforcing a state law on ‘illegal presence,’ which is not a Federal crime.

I’m from the border and from a line of government / LE people there. It was explained to me in the early ‘60s that Posse Comitatus (PCA) was the motivation for using the BP since ordinary individual border crossing was not considered a military issue, just a legal issue.

Is it an invasion now and meriting a military response? It’s a matter of debate. Think that the enormity of what’s happening and the fact that many are from countries openly hostile to the US would mean it can be characterized as one. But General Santa Anna is not leading his troops in uniform and in formation, so it’s subjective.

The USSC has just recognized that being here illegally is a criminal act and is arrestable. (I think that the USSC finally understands the existential threat Biden's invaders pose to this nation). Red states should pay heed and begin enforcement forthwith.

I want to expand this a little bit. We know that blue states use the presence of millions of illegal aliens to boost population numbers during the census to gain extra congressional seats. Could red states now challenge that? Can red states petition the courts and make the point that blue states conspire with known criminals to gain extra political power? And if blue states continue the practice of using criminals to gain more political power, can the courts censure the states and strip them of illegally gained congressional seats? And maybe the courts can warn the blue states that continued use of illegal aliens to gain political power may result in their elections being decertified?

Thank you. The regime has not only failed its constitutional duties to secure the border, it has bypassed lawful immigration rules by directly flying illegal aliens into the United States. IOW, the Biden Administration has massively aided and abetted the breaking of United States laws. With regard to children, the Biden Administration has enabled foreign nationals to traffic children in violation of international law. Such a disgraceful administration!

Outstanding observation. Without resistance, the Administration is going to continue to allow tens of millions of foreign nationals to invade and occupy America! I think the USSC has finally said enough is enough.
