Why GA Judge Won’t Disqualify Fani Willis

Any rational person familiar with the behavior of Fulton County District Attorney Fani Willis during the prosecutorial misconduct hearings that finally ended last Friday has probably concluded that her conduct has created the “appearance of impropriety.” This, according to defense lawyers for former President Trump and several co-defendants, is sufficient to disqualify Willis and the Fulton County DA’s office from prosecuting the RICO case they launched last August. Indeed, defense attorney Harry MacDougald cited six examples of actual conflicts of interest, any one of which is sufficient to disqualify Willis and her office. Yet it’s unlikely that it will happen.

Why not? The decision must be made by Superior Court Judge Scott McAfee, who said on Friday that he would rule on the motion to disqualify Willis and her office in about two weeks. Unfortunately for the defendants, McAfee is a temporary appointee to the bench who must face Fulton County voters for the first time about 60 days after his ruling. Georgia’s Republican Gov. Brian Kemp appointed him last year to complete the term of retiring Judge Christopher S. Brasher. According to McAfee’s campaign website, his election will take place on May 21. Fulton County, which includes Atlanta, is overwhelmingly Democratic and its voters will be less than pleased with the judge if he disqualifies Willis and her office.

Further complicating matters is the fact that McAfee once worked in the Fulton County DA’s office and was supervised by none other than Fani Willis, according to a report in the New York Times. This presumably explains his weirdly passive response to her disruptive courtroom antics during her February 15 testimony. He allowed her to ignore questions, accuse defense attorneys of lying and imply that they represented a threat to democracy...

The judge was a member of the federalist society at the U. of GA... and is a Republican in GA...somehow I think his goals might be higher than Fulton county..

I actually think the two-week delay is a positive sign. If he was going to allow Fanni to stay on, he could have ruled immediately.
The two week delay is the last day a challenger can put their name on the ballot. Hard for him to be voted out if his name is the only one on the ballot.
I think Fanni is gone.


The judge is buying time for something. They could be engineering something like a new DA, or court appointed special prosecutor or something. Don't ever underestimate how corrupt our judicial system is.

I think Catron’s screed is just that. Tired, everybody knows what he says before he says it, and frankly, just a pessimism of low expectations.

Wade, Willis and Bradley were pretty well BOXED in and are liars - cash, my patootie - PATHETIC. The defense’s closing arguments were powerful and that state’s summation was abysmal and nonsensical at best. You could see it on Willis’ face - she wasn’t pleased.

The judge will have to disqualify the pair on the basis of appearance of conflict of interests alone. If he believes (as he should) they actually DID have a conflict and LIED, the whole DA’s office might get disqualified because every one of the state’s lawyers knew and accepted perjury without objection.

I think this article may be incorrect. He’s waiting 2 weeks to get outside the window of a challenger.

So if within the next 2 weeks no one challenges him...he runs unopposed. At least that is what a couple pundits said.

So were all three of Donald Trump's limp wrist Supreme Court appointees.

All three might have been Republicans, too, but I would need to check before claiming that.

Why GA Judge Will Disqualify Fani Willis

People who say that Judge Scott McAfee is in the tank for Willis are giving her too much power. She may be the Big Fish in the small pond of Atlanta, but she's a small fish in the larger pond of Georgia.

At the state level, we have Governor Kemp who already appointed McAfee twice to increasing positions of authority after U.S. Attorney for the Northern District of Georgia Byung J. “BJay” Pak initially appointed McAfee as Assistant U.S. Attorney for the Northern District of Georgia.

If McAfee rules in favor of Willis and Wade on some narrow technicalities and let their conspiracy of fraud stand, he will be effectively throwing away the rest of his reputation and legal career.

If McAfee makes the bold ruling and calls out what is clear to everyone else, he will secure his place in the Georgia judiciary. I believe his next career move will be an appointment to the Georgia Supreme Court by Gov. Kemp.

McAfee will be pilloried by the left, but the right will say it was the day that lawfare died. The one-two punch will be SCOTUS ruling for President Trump on the 14th amendment cases and McAfee ruling to remove Willis and Wade from their RICO case against Trump.

If the Judge tosses Fani Willis off the case, he may lose his election in May, but he’d be a lock for a U.S. District Court nomination.

I’m sure he has this figured out.

No, she’s gone.

This is just the beginning of witnesses and evidence. If the judge doesn’t get rid of her now, there will be constant new evidence and motions to force her out. It doesn’t end until she’s gone and the judge knows it

I watched hearings - thought Scott McAfee handled well and will do right thing.
And if I were Wade or Willis, I would like to be thrown off so I can work on not being disbarred.
