Supreme Court Responds to Trump Request to Pause Immunity Ruling in Jack Smith January 6 Case

The US Supreme Court on Tuesday responded to President Trump’s emergency application requesting the high court pause the immunity ruling in Jack Smith’s January 6 case in DC.

Chief Justice Roberts on Tuesday responded to Trump’s emergency request and told Special Counsel Jack Smith he has a week to respond.

The Supreme Court gave Jack Smith until Tuesday, February 20 to file a response to Trump’s request to pause the appellate court’s ruling on immunity.

Last week a federal appeals court stacked with Biden judges denied Trump immunity in Special Counsel Jack Smith’s January 6 DC case.

The three-judge panel for the DC Circuit Court of Appeals ruled on Trump immunity claims: Florence Pan (Biden appointee), Michelle Childs (Biden appointee), and Karen Henderson (George W. Bush appointee).

“We have balanced former President Trump’s asserted interests in executive immunity against the vital public interests that favor allowing this prosecution to proceed,” the three-judge panel wrote.

“We conclude that ‘concerns of public policy, especially as illuminated by our history and the structure of our government’ compel the rejection of his claim of immunity in this case,” they wrote.

Immunity is required for the office of President.

Did you ever wonder why after the revolution they wanted to make George Washington King? That really never made sense to me until I thought about it. The chief executive requires immunity to operate during their term. The presidency is and extremely special position, like a king with a term and many checks and balances. Remember, the colonists weren't so much against the monarchy as they were against having their natural rights trampled upon. They tried to avoid war and settle with the crown for years before the first shots were fired. And Jefferson himself said in the Declaration himself "Prudence, indeed, will dictate that Governments long established should not be changed for light and transient causes; and accordingly all experience hath shewn, that mankind are more disposed to suffer, while evils are sufferable, than to right themselves by abolishing the forms to which they are accustomed."

Plus, the election of President was setup in a very particular manner (electoral college) because the presidency is so special and came with so many privileges, responsibilities and immunities. This is also why when people whine about the electoral college they don't fully understand or appreciate the amount of forethought, certainty, requirements (natural born citizen for one) and rules that went into setting up this office.

If immunity was not granted during their term they could be charged with any thing that a majority didn't like about action or non-action they took during office.

The people can remove the immunity thru impeachment and conviction by the Senate. The former president is not immune to prosecution once they are out of office.

Most everything was setup in the Constitution to be very specific and major changes to governments which create policy, laws and taxes move very slow in order that change also happens at a slow pace.

Much like a Cathedral, our Constitution was created meticulously over a long period of time with much debate to have a very stable foundation. Due to this restrictive foundation (constitution) the Cathedral is built stone by stone to last a long, long, long time to give what was built the best chance to endure.

I agree it’s a bogus case, and Roberts is not my favorite judge, but so far in this case all he did was give Smith a short deadline.

I just do not trust Roberts at all, because he has made so many unconstitutional rulings. I think the man may be so compromised that he is controlled.

He has not been indicted or convicted of sedition or treason. This is a farce.
Meanwhile these fascists like Smith have immunity and can abuse their power with impunity.

That has to be weaker than Harry Blackmun’s “emanations and penumbras”.
I mean these people just used some 25 cent words to show how lazy and biased they are.
I want to say, “Unbelievable!” But maybe the correct word is “Conspirators!”

Our judicial system is one which was set up by attorneys, run by attorneys, primarily for the benefit of attorneys. Life time appointments, immunity, staggering amounts for legal fees, etc. They’ve set things up pretty well for themselves.

Well. yeah because he asked them right out if it was a tax, to which they responded no, which was giving them a hint that they didn’t recognize was a gift to them, yet he still ruled that it was a tax as justification.
