Going maskless during COVID-19 emergency isn’t a free-speech right, court rules

The 3rd Circuit Court of Appeals rejected the argument that refusing to wear face masks at school board meetings during the COVID-19 outbreak constitutes protected speech under the First Amendment.

The court ruled on cases involving individuals who claimed retaliation by school boards for not wearing masks at public meetings.

The court emphasized that disobeying a masking requirement does not fall under protected speech, comparing it to other forms of non-compliance with the law.

The 3rd Circuit Court of Appeals ruled, “A question shadowing suits such as these is whether there is a First Amendment right to refuse to wear a protective mask as required by valid health and safety orders put in place during a recognized public health emergency. Like all courts to address this issue, we conclude there is not,” the court said.

“Skeptics are free to — and did — voice their opposition through multiple means, but disobeying a masking requirement is not one of them. One could not, for example, refuse to pay taxes to express the belief that ‘taxes are theft.’ Nor could one refuse to wear a motorcycle helmet as a symbolic protest against a state law requiring them,” the court continued.

Seems to me that valid is the key term. If the order is based on nothing, junk science, proven false, etc. than that order should be invalid and officials forcing compliance are violating civil rights, not just freedom of speech.

Forcing people to engage in pseudoscientific rituals. Masks are pointless.

I think the court is right . . . it’s not a First Amendment free speech right. Rather, it is the right to be left the hell alone.

Yep, the question is does a mask work? If wearing a mask protects the person wearing it who cares what other people do. First it was wearing mask, then it was wearing a N95 mask to prevent the spread. Then it was oh no the N95 does not work, wear a N100 mask. So mandatory wearing something which does not work is useless!

I agree. This wasn't a First Amendment issue. This was a bad executive order that was enabled by bad law.

It was worse than that, the government did a censorship operation to silence and stop all dissent thereby ensuring control. And worse again there is no punishment against the government overreach because they thought they were doing the right thing.

In 2020 I pulled up to a red light. There was an attractive young lady in the car next to me. Both of us had our windows rolled up. I sneezed, loudly. The girl looked at me in horror and pulled up her cloth mask.

The next time I’m in the operating room I’m going to demand the operating room team remove their masks, they’re f**k*** pointless!

I gonna quit wearing my seatbelt too! hell nobody can tell me what the f*** to do!

Motorcycle helmets! Oh hell no!

I quit watchin’ helmeted sports, PBR is now off my list, NASCAR has been banned in my house for decades.

The British have ugly teeth they need to keep their masks on!

you’ve got it right FRiend. it’s not a 1st Amendment right.

it’s really imho, a 4th/5th amendment protection against unwarranted gov’t invasion of your person. your ‘life, liberty, or property.’ specifically your liberty and person by forcing a medical procedure on you. they get around the property right and others by giving the mask or jab to you for free.

it’s basically an unalienable human right that you get to voluntarily consent to *any* so called medical procedure on your person whether a person or the gov’t desires it for you or not. recently we all experienced the gov’t and their private agents running amok, violating our consent right by coercing employees, businesses, military personnel and even school children into taking experimental, unproven and arbitrary health procedures. imho, there ought to be consequences, trials and compensation for all the damage they have done.
