No person is above the law. Presidents merely get a stay on civil and criminal prosecutions.
If Joe Biden was breaking laws to let in invaders for political gain, he can be prosecuted when he leaves office, as can any accomplices.

Note: I do not believe Trump should have immunity. I also think judges should be held to the same standards as Trump should. If a reasonable person likely to hold the office could think the action is reasonable, the follow-on lawsuit should be dismissed with prejudice.
