Since the city of Oakland, California does not protect business owners from criminals, a business owner told NBC News:

"Shoot them. I'm well armed, legally armed, and I promise you, somebody step foot, tried to do something, I will kill them, because the city won't do anything about it. I will do something about it. There is nothing, there is no other choice for me to do.”

These people are idiots.

Proclaiming this kind of thing to the press just sets them up for prosecution. Premeditation much?

Never talk to the police. Only. “I want a Lawyer. I was in Fear For My Life.” nothing else.

In the end, he’s right. It’s either defend your way of life and business from destruction by criminals who’ve been given free rein over society, or submit and suffer at their hands.

A legal action based on Amendment XIV might be possible.

The equal protection clause came about because attacks against freed people in Memphis and New Orleans in 1866 were not stopped by the states in which those cities were in.

I understand the frustration. The police can’t or won’t do anything about it. But they will arrest you for protecting your property.

It has been proven time and time again.

The Police have NO Legal Responsibility to Protect People.

The Police are Not liable if somebody gets hurt, robbed, killed, etc.

Their job is to draw a chalk line around the body. Then find and prosecute the perpatrator. Enforce the laws. NOT be a body guard to every person 24/7.

Sadly, the first one to do it faces a very public arrest, swift prosecution and conviction.

A signal to others.

You know...kind of like locking up and imprisoning folks who walked through the Capitol and now going after those that were outside.

They should hire some Koreans, they seem to be pretty good at it. But, then again, that was a different time.

What’s even worse, those that implemented these policies aren’t the ones affected by them, so they don’t care. It isn’t their businesses being destroyed.

Many small business owners came to the US seeking asylum.

They might have not formally applied for asylum but that is why they came.

My mother’s parent fled Turkey. After working in a foundry, my mother’s father opened a store. My mother as a young girl helped in the store.

These attacks on foreign-born businesspeople are of the exact same nature as the attacks on blacks taking up opportunities in 1866 Memphis and New Orleans.

Blacks in big cities resent the relative success of Asians much in the same way Arabs in Mandate Palestine resented the success of Jews in converting underutilized land.

And if you shoot them, you can guarantee you will be prosecuted for it, claiming the criminals were the real victims.

Doubtful. The Supreme Court has ruled on numerous occasions that the police have no duty to protect you or your property. They exist to take reports after the crime.

“The Police have NO Legal Responsibility to Protect People.”

Amendment XIV places responsibility on each state to protect people from racist attacks.

It needs to be used as it was intended to be used.

And in this case, the criminals include the police and politicians.

.....what Oakland business people will have to do is ORGANIZE and have armed patrols that can respond when police do not!

That’s called vigilantism but vigilantism is a practice that is centuries old. Then, the same “organization” should sue Oakland for a refund of taxes.

“Amendment XIV places responsibility on each state to protect people from racist attacks.”

So, under this theory. ANY “Hate crime” or “Racist attack”
the Police AND the state can be held responsible and liable for all damages?

Then, as liable, prosecuted or arrested for failing to stop these crimes?

As they say, “All hat, no cattle”

We will beleive it when it happens- until then it’s just blather and false bravado. Announcing it was really stupid.

Yup. This person is completely hosed if anything ever happens to a perp on his property.

“Desperate times call for desperate measures”, yes they are putting themselves out on the tip of the spear, but the City/State has pushed them up against the wall. This needed to be said and someone is going to be martyred before it changes. Sad but true.
