Donald Trump is seeking to have his Washington, D.C. election interference case quashed, calling it a "vindictive prosecution."

e electors are a criminal conspiracy or a symbolic act of defiance that is rooted in American history.

Much of his submission, filed early on Tuesday, hangs on whether alternative electors are a criminal conspiracy or a symbolic act of defiance that is rooted in American history.

Even though this article is from Newsweek, it give an excellent summary of what the whole "fake electors" dispute is all about and shows Trump has a good chance of winning it.

My high school history teacher believed that Hayes used fake electors against Tilden in at least some oc the disputed states.

AP-—Their defenders call them “alternate” or “contingent” electors, saying they were just trying to keep Trump’s legal options open as a lawsuit challenged Georgia’s election results. Some Republicans argue Trump never got a fair shake in Georgia because that lawsuit was never tried, despite a state law calling for election challenges to be heard within 20 days. A Georgia Republican Party website raising money to defend electors calls them “patriots who served.”

“If we did not hold this meeting, then our election contest would effectively be abandoned,” Shafer said during the December meeting, talking to attorney Ray Smith, who was there advising the electors and was also indicted. “And so the only way for us to have any judge consider the merits of our complaint, the thousands of people who we allege voted unlawfully, is for us to have this meeting.”

GA Republican party chair Shafer defended his actions then and now by citing an episode that played out in Hawaii in 1960. Democrats met that year after Republican Richard Nixon was certified as the state’s winner and sent three electoral votes to the U.S. Senate backing John F. Kennedy.

Todd Zywicki, a law professor at George Mason University in Virginia, signed a July 11 declaration concluding actions by Shafer and other Georgia Republican electors were “lawful, reasonable, proper and necessary” considering the election contest and the Hawaii precedent.

Lawyers for the indicted electors argue it was up to Congress to determine which slates should be counted.

Huh. Relying on the Constitution and Bill of Rights might succeed?

Go figure.

Thank you.
But one of the REALLY big problems in the USA today (and we have many, many problems) is the lack of any knowledge of HISTORY.
If one were to understand how the election in which Thomas Jefferson became President (and Aaron Burr became his VP), it would be quite an education to see that multiple ballots to arrive at a Speaker of the House (for example) is not unusual, or even bad.

I pray daily for this and many things good for our country. Still praying.

This case should have been dismissed on day one, but since the charade continues, when it is dismissed with prejudice, every last participant should be RICO’ed for Deprivation of Rights and a whole host of other charges.

lack of any knowledge of HISTORY

People of all stripes have forgotten that “struggle is real”. Freedom is never free and easy.

GA Republican party chair Shafer defended his actions then and now by citing an episode that played out in Hawaii in 1960. Democrats met that year after Republican Richard Nixon was certified as the state’s winner and sent three electoral votes to the U.S. Senate backing John F. Kennedy.

This is a critical point, and it should be the fundamental point of any report on the "fake electors" case. What hardly anyone mentions even in a narrative like this is that the "alternate electors" in Hawaii in 1960 ended up being the valid electors AFTER the recounts and legal challenges were completed.

What this means is that if the Democrats did NOT appoint a slate of electors in 1960, the election would have ended up with: (1) Kennedy declared the winner of the popular vote in Hawaii, and (2) Nixon winning the state because he was the only candidate with electors appointed on the day designated by Congress in mid-December.

After the 2020 election and before the indictments, I remember reading MSM articles that democrats planned to name alternate electors if Trump had been declared the winner. Now I cannot find them. Apparently they have been wiped from the interweb.

I don’t recall that Hayes was prosecuted and imprisoned for those actions? Why not if good enough to bludgeon President Trump with it?

The prosecution says the electors committed a crime by signing on.

I despise the way Demon Rats have treated Trump. Worse is the way the RINOs have treated him. He gave the party a win, and they hated him.

I am talking about the Beltway clowns like McConnell and his ilk.

I do not include most of his primary opponents.

this is a political persecution to hurt an opposing political candidate

it has nothing to do with the law

the process is the punishment

It’s not about the law so Trump has no chance of winning. What they might do is allow him to “win” one of these fake cases as a way to make the whole thing look legitimate. They’ll allow him to win the one that goes first. Trump will go hard on that thanking the judge and that will give legitimacy to the process, by Trump himself then closer to elections They’ll put out one where he is convicted. They may even let him with 3 of the 4 so it looks even more legitimate. Don’t kid yourself. This is pure weaponization of the law and it’s all to make sure Trump will never be President again. Netflix or Republic. Most people will choose Netflix.

I know what the prosecutors are saying. My point is that it wasn't a crime in 1960, and it wasn't a crime in 2020 for the same reason.

And the 1960 case demonstrates why it's actually a legitimate, sound, defensible and even NECESSARY strategy to appoint a set of alternative electors in a case where the ultimate outcome of a state's presidential election is still in dispute.
